Mr. Daly thea asked if boats are normally allowed in a commercial area? Mr. Hanks said <br /> as far as he knew they were. He went on to explain that if there is a floating aquaculture, you can't <br /> get through. If there is aquaculture on the bottom, however, he believes they are allowed. <br /> Mr. Daly then said that what we should emphasize is that these areas have to be marked <br /> properly because they become a navigation hazard if they are not marked properly and the <br /> markings are not maintained. <br /> Mr. Hanks asked in conjunction with the areas narked clearly, do we want to say that the <br /> areas should be open to navigation? Mr. Fordham said that he believes that has to be past of the <br /> agreement to begin with, whether they are open to navigation or not. <br /> Mr. Fordham reiterated that he thought responsibility should be important. who is <br /> responsible if you damage anything? <br /> Mr. Silver said he believed we would be negligent if we allowed any kind of floating <br /> material to be in our waters in the areas that boats navigate. He believes the Harbormaster has to <br /> insist that the shellfish grants are not put in the areas where boats are going to be. Mr. Silver <br /> believes if we have designated areas,the boats should stay away from them. The designated areas <br /> should not be where the beats navigate. <br /> Mr. Silver suggested that we schedule a meeting with Mr. Ellis to see what his thoughts <br /> were. Ir. Hanks then asked if we should have a joint Shellfish Commission and waterways <br /> Commission meeting. Mr. Silver said before we do that., we should meet with lair. Ellis to see what <br /> he thinks. Mr. Hanks suggested that individually everyone do that rather than have an official <br /> public meeting. <br /> Mr. Daly said he did net see any problem with the Commission taking a position backed <br /> up with a letter sent off with Mr. Ellis to the Board of Selectmen. Mr. Hanks Hien asked if he was <br /> thinking of a position that adapts the moratorium or says this is what we insist upon and we dont <br /> care about the moratorium. Mr. Silver said he believed the latter. <br /> 11r. Taylor suggested that we push for designating certain areas as ones that could have <br /> grants and eliminate anything else and make sure the grants are outside the main traffic area. <br /> Mr, Daly said he believes we will be discussing that one next year. That is out of our <br /> controt. one thing that is in our control is enforcement of the regulations to ensure that navigation <br /> is not obstructer)in any way at all. <br /> Ir. Baker questioned where the waterways begins and ends. He wanted to know if the <br /> Waterways would be interested in anything that impacts eel grass or the total number of shellfish <br /> that exists in the bay. Mr. Hanks said traditionally the answer would be no. He went on to say <br /> that the waterways Commission is focused primarily on navigation. <br /> Mr. Hanks said his problem with the moratorium,is he sees no sense in a moratorium if <br /> you don't:use the time to solve the problems, He does not see a need for the moratorium. <br /> 4 <br />
