9 January 1997 <br /> Page 12. <br /> Mr. Sherman stated Mr. Whritenour sent a memo to Leigh Potter stating <br /> when there is a 1" storm, remove three boards. The Commission was not <br /> copied. ale told Mr. Potter it is not legal and he should not take any such <br /> action until the Commission gets a letter from DEP and Town Counsel that <br /> this can be done. it is wrong for Mr. Whritenour to urge this. <br /> He suggested m* forming Leigh Potter and Mr. Whritenour that until assured <br /> by DEP and Town Counsel, nothing should be done. He suggested sending a <br /> memo to DEP to say that it had never been established this can legally be <br /> done and send the same memo to Town Counsel as ng if it can be done. <br /> VOTE: Motion made and seconded to have the Agent send letters to'down <br /> Counsel and DER Unanimous Vote. <br /> Mr. Shaw thought these letters should be issued over the Chairman's <br /> signature. It was noted the Chairman is away until February. <br /> There being no further business to come before the Commission, the meeting <br /> was adjourned at 9:50 p.m. <br /> Res ectfu y submitted, <br /> e � <br /> Diana M.
