She suggested something <br /> indigenous to the area, as well as something that would improve <br /> wildlife habitat-. Mrs. Bertoli was amenable to suggestions made <br /> by the Commission. Vista pruning would be permitted during the <br /> noxi-growing season, November through larch; a requirement would <br /> be made that Commission management ent uidelines would have to be <br /> followed. Kathleen explained to Mrs. Bertoli that the Commission <br /> would want to know who has been retained for said pruning work <br /> before the order of Condition is issued. Before an order of <br /> condition is renewed, the Commission would make ars inspection of <br /> the property. <br /> The Clerk explained that the original order of Condition on <br /> said property was never recorded and has since expired. Mr. and <br /> Mrs . Bertoli appear before the Commission in an attempt to renew <br /> and accomplish some of the original conditions. <br /> TION: Elliot Rosenberg rade a lotion to close subject t <br /> the submission and approval by the Agent of a Nista <br /> Pruning/vegetation Paan, as well as the DEP numbers; which Notion <br /> was seconded by Harry Desrosiers and so voted unanimously. <br /> Post Hearing Agenda-Continued <br /> . Kathleen provided an update-Lake management Committee <br /> Memo. <br /> 7 . Kathleen asked how legitimate ownership is established. <br /> Elliot Rosenberg clarified the signatures on the Attestation 4 <br /> Form and on the ,application should conform. The owner has to <br /> become party to the proceedings. <br /> New Business: 1 . Elliot Rosenberg amended language <br /> regarding emergency work: "The permit and application, prior to <br /> the commencement of the work required by this chapter shall not <br /> apply to emergency projects necessary for the protection of the <br /> health or safety of the public, prodded that : 1 The work is <br /> to be performed by or has been ordered to be performed by ars <br /> agency in the commonwealth or a political subdivision thereof . <br /> Advance notice, oral or written, has berg given to the <br /> Commission prior to the commencement of work or within twenty- <br /> four hours after commencement. The Conservation <br /> Commission, or its agent, certifies the extent of the work <br /> necessary to abate the emergency. permit application <br /> shall thereafter, within a reasonable time, be filed with respect <br /> to both the emergency abatement and such other work as may be <br /> necessary or desired. f1 "Upon failure to meet these requirements, <br /> the Commission may order all such work stopped. . .etc. , etc. " <br /> MOTION: Harry Desrosiers made a lotion to accept changes as <br /> proposed by Elliot Rosenberg; which Motion was seconded by George <br /> Green and so voted unanimously. <br /> -lo- <br />
