18 September 1997 <br /> 'age 2. <br /> 7:30 NEW SEABURY COMPANY LP to amend the Order of Conditions for <br /> SE 43-1260 for continued maintenance and replacement of beach fencing <br /> within areas subject to previous beach nourishment approvals along <br /> Nantucket Sound. <br /> Ms Terrio advised Mr. Grotzke was not available for tonight's hearings. He <br /> was asked to address the Natural Heritage map which did not originally <br /> consider this as a sensitive area, noir it sloes. Also, there have been no beach <br /> profiles for quite some time. As far as the beach fencing, it is there, it had to <br /> be an amendment because it had never formally been requested. <br /> W. Sherman stated the fencing was there before it was State listed for <br /> Plovers. He felt it was in order for him to call Natural Heritage for a direct <br /> answer. The Commission agreed. Norman Hayes has informed hien, because <br /> BSC does all of the beach prong for the whole area, than New Seabury is in <br /> default in tens of their contribution for the profiling and he saw no reason to <br /> amend it and extend it until they have lived up to the terms of the first order. <br /> The Chairman suggested the hearing be continued and if the applicant <br /> refuses consent to the continuance the request should be denied.. <br /> VOTE: Motion made and seconded to continue the hearing to 9 October 199' <br /> providing the applicant consents and subject to the Agent not finding <br /> any problems from Natural Heritage and receipt of a letter from BSC <br /> with an agreement that Neter Seabury has committed to hiring therm <br /> or an equivalent qualified person. Unanimous Vote. <br /> HEARING CONTINUED TO OCTOBER 9, 1997 A :1 P*M@ <br /> 7:40 CIN DEVELOPMENT for construction of a pool, patio, fence, <br /> vista pruning in perpetuity, and general landscaping at 14 Glenneagle Drive. <br /> Ms Terrio, advised there is an ownership issue. Mr. Grotzke has advised they <br /> are in the process of passing papers. <br /> Mr. Rosenberg stated if the present owner is not on the application the <br /> hearing should be continued. <br /> Mr. Sherman stated the deficiencies should be put on the record. <br /> Ms Terrio stated the house has not been built.
