18 September 1997 <br /> Page 5. <br /> Mr. Tony Agnitti advised his property is across the water from the proposed <br /> site. He stated he would like to see an aerial of the site. This proposed <br /> commercial docking site is right in the small ofthe bay. According to the plea, <br /> there is only five lots in the subdivision on the water and they are as ng for a <br /> docking facility for 12 boats. Also, there are 2 - 3' x 3' piers, used on a <br /> cornnercial structure, wMch would cause a tremendous .hnac on wetlands <br /> and shellfish in the area. They are basing this on a orae-slip docking structure, <br /> the parameters for this. Whose are the feelings of his attorney. He has been <br /> attempting to get information from BSC. It is over 100 feet long, if the scale <br /> is correct. <br /> Mr. Johansen advised it is 160 linear feet. <br /> Mr. Agnitti advised he urns four interior lots, as Drell as his hone on the <br /> water and asked what would happen if he put a structure le this on the <br /> water and leased the spaces out for the interior lots? They are trying to get <br /> docking rights for their properties, to do an end-around to get an easement to <br /> avoid environmental impact which they are not doing. What would stop him <br /> from doing that afterwards if this is permitted? <br /> Mr. Desrosiers stated the size of this structure violates the Commissions <br /> . <br /> policy limiting structures to 2per structure for float facilities. He felt this <br /> gentleman was right. <br /> Mr. Rosenberg suggested to Mr. Agnitti, based on what he heard tonight, that <br /> he should consult with his counsel and should get something in writing to the <br /> Commission ssion in the next two creeks setting forth the L exi . he put to the <br /> Commission tonight. There were a number of legal issues raised, as well as <br /> environmental issues. If Mr. Agnitti would Eke the Commission to consider <br /> his statements, he stated they ought to be provided in writing so the <br /> Commission can review them and demand answers formally. <br /> Tony Agnitti stated they are going for a superstructure. This is h eraliy <br /> where the bay bogs, at the bottleneck of that bay, his hone is out at one edge <br /> and then it opens up to a pool area. He can conceive that any neighbors three <br /> doors down, who are on the water as well, will be just out of range of that <br /> superstructure, which is what they call it in the application. <br /> Mr. Sherman stated it should be made clear that the aspects of what this dock <br /> will do to Mr. Agnittfs property value is nothing the Commission can act on. <br />
