He advised he has had discussions with the Agent and submitted a <br /> report. Grant money was used and the structure was built m* good faith. <br /> There are numerous violations. Mr. Sherman wanted a site specific profile to <br /> determine whether the crib is in the V zone or A zone. <br /> Mr. Hayes recomr' ended deferring to DEP. There is an obvious safety issue if <br /> the stairs are not there. The environment is being impacted; the eddying <br /> effect is causing erosion in the corner. <br /> fir. Sherman dict not think anything elegant is needed for a probe, he <br /> suggested they just shoot an elevation to find where the 15 foot elevation <br /> comes at the crib. <br /> Mr. Hayes stated 0% is in the A Zone, 20% is in the V Zone. <br /> Mr. Sherman stated there is another issue, sand was washed away in a storm. <br /> The DPW tried to improve things and made something more permanent, <br /> instead of sand, which constitutes armoring. There will be scouring. It has to 4 <br /> go. <br /> Mr. Mayes stated he could not argue. The Board is upholding performance <br /> standards of the Act but DEP has the power to take into consideration ail of <br /> the accornpanyIng issues. It is on Commonwealth of Mass. Land. <br /> Mr. Sherman would be wing to talk to dim Mahala. He has to go by what <br /> the regs say. <br /> Mr. Fitzsimmons thought it was a very favorable installation. He stated he <br /> was not sure where this was going. Mr. Sherman stated itisegai. Mr. <br /> Pit simmons stated the Commission approved it. Mr. Sherman stated but not <br /> in that form, they added stone and instead of replacing sand they built an <br /> armored structure and added a pad to it. <br /> Mr. Desrosiers stated it was a 2-1/2 foot step off the bottom and is now a lot <br /> safer and in keeping with the needs of the community. <br />
