i <br /> i <br /> ML4SHEE CONSERVATION COMMISSION <br /> Minutes of 20 November 1997 <br /> Commissioners present: John Fitzsimmons, Elliot Rosenberg, David i <br /> Sharpe, Ralph Shaw, Harry Iesrosiers, <br /> George Green Jr., John Johansen, Greg <br /> irsen. <br /> The Chairman called the meeting to order at 6:55 p.m. <br /> 6:55 PUBLIC COMMENT PERIOD: Norman Mayes carne forward to <br /> speak on two issues. On behalf of Mashpee Land Investment L , he advised <br /> the application is withdrawn. Abutters were so adversarial the proponents <br /> decided not to go forward. The three individuals who bought lots will b <br /> corning in for docks. <br /> Second, concerning the stairs at Wading Place, Jim Mahala of ILEI' told him <br /> he was proceeding on the wrong route and should follow the process with the <br /> Commission. He agreed with Mr. Sherman on interpretation; the crib is <br /> within the V-Zone. He submitted a letter stating they could proceed to amend <br /> the Notice of Intent or they could submit an After-The-Fact Notice of Intent. <br /> The Commission could then make a decision and DEP could make a <br /> jurisdictional. decision. He is working between three department heads and <br /> the pocketbook of the town. <br /> Nhr. Sherman stated, if going for a variance, they would have to have been <br /> through the process. If seeking an amended order, that is his right, but Mr. <br /> Sherman would recommend turning it down because the amended order is not <br /> intended for anything other than minor changes. <br /> Mr. Rosenberg stated the Commission would have to deny the permit to <br /> amend. <br /> Mr. Sherman dict not see the efficacy of spending money on the Notice of <br /> Intent.. There would not be any fees but it could not be permitted as it clops <br /> fall outside the scope of the policy on coastal banks; vertical wahs aro a no-no. <br /> He dial not see any alternative but to deny it. If DEPsuccumbs, they would <br /> be abrogating their own regs. He would hate to see this happen as the town <br /> would have Town Counsel representing one town department against another. <br /> It makes sense to remove the armoring. The DPW would resent that. <br /> The Chairman asked for suggestions. <br />
