December 1997 <br /> Page 5. <br /> Mr. Sherman stated there is one other issue, there is an existing water line <br /> going through the bank and there is no dock and asked it's purpose. Mr. <br /> Slavins y 'stated there are a couple of small piles as though there might have <br /> been a dock down the stairs. Mr. Sherman wanted to know what that is <br /> hooked up to so there won't be a rupture at some point. If not needed, it <br /> should be removed; if needed, it should be permitted. Mr. <br /> Sherman interjected that it should be clear he is taming about Zoning Board <br /> of Appeals statute. They also need a variance for the ACEC. They have been <br /> able to get a Fast system in here. Four bedrooms is allowed by the nitrogen <br /> calcs. A letter was subnititted to Jing Mahala re how the Mate is interpreting <br /> the ACE C line. <br /> Mr. Sherman asked Mrs. Terrio to explain the concept. Mrs. Teruo was <br /> unable to locate the letter Brom Michael Stroman of DEP. <br /> Mr. Hayes did not know whether that letter was being enforced. Mrs. Terrio <br /> stated there can be no adverse effects within the ACEC. <br /> Mr. Fitzsimmons mons stated the burden of proof is upon the applicant to prove <br /> that there is no adverse effects.
