December 18, 1997 <br /> Page 8. <br /> Public comments. none. <br /> VOTE: Motion made and seconded to continue to 22 January 1997 at <br /> 7:40 o p.m. at the request of the applicant. Unanimous Note. <br /> HEARING CONTINU D TO 22 JANUARY 1998 AT 7:40 PPM, <br /> :20 EDWARD MO AN for the construction of a natural and/or peastone <br /> path leading from existing house to the edge of the Bordering Vegetated <br /> Wetland and to permit and maintain a walkover structure, dock and float at <br /> 126 Waterway. Receipts for abutter notification were provided by Norman <br /> Hayes. He gave a history of the project and advised the plan shows what is <br /> there. The work inside the hayb .e line was done under an Order of <br /> Conditions. Field notes were entered into the record. 22 trees are to be <br /> removed. There is an 8' w way. fir. Sherman stated that would not pass <br /> but a.4' could be conditioned. <br /> Mr. Hayes advised a shellfish analysis was done showing they are in the area. <br /> His client is willing to wort with the She Rsh Warden to remove thein during <br /> construction. <br /> Mr. Sherman had a problem with the vista pruning, this would require <br /> renotifying abutters and readvertising to add this to the description of work. <br /> Also he stated there are some dead trees but policy requires for living trees <br /> that only 20% removal be allowed unless they want to substitute three shrubs <br /> per tree. The Commission cannot get Mnt the vista pruning because it was <br /> not included. <br /> Mr. Hayes stated he will submit to the Shellfish Warden when he files for <br /> Chapter 91. <br /> Mr. Sherman stated slash has been thrown into the area and has to be <br /> cleaned up. He asked Mr. Hayes if he wanted to proceed on the dock and <br /> come back with the vista pruning? Mr. Hayes would defer on the vista <br /> pruning. fir. Sherman stated he will need a new plan for a four foot pathway. <br /> Mr. Hayes advised he has not filed Chapter 91 yet. Mr. Sherman stated the <br /> hearing could be closed pending new plan showing the four foot pathway and <br /> clean, up of the slash. The vistapruning-will be deferred. <br /> Mr. Fitzsimmons questioned numbers on the plan and was told they are <br /> depths. <br />
