MASHPEE CONSERVATION COMMISSION
Minutes of 22 January 199$
i
Commissioners present: George Green Jr., Chair Pro Tem, John
Johansen, David Sharpe, Ralph Shaw,
Greg wsen.
The Chair called the meeting to order at 6-.30 p.m.
6:30 REGULATIONS FARING: Present for this hearing were Paul
Lumsden, Steven Ball, Edward Baker, ferry Ellis and lick York.
The Chair ope ed. the public hearing on the Town of Mashpee Conservation
Bylaw, Chapter 172, Rules and Regulations concerning wetlands, to receive
comments and for the adoption of regulations promulgated under Chapter 172
of the ilashpee Code.
Mr. Sherman offered to answer any speck questions put forth by the
audience.
Paul Lumsden of Pirates Cove respectfully requested that the Commission
postpone the hearing until June or July of the present year to allow most of
the people affected by what will be done at this hearing, to make comments
that might change the Commission's minds. He has no issue with what is
being considered.
Mr. Sherman stated that subject has been brought up by others but he
disagreed as it would be setting a unprecedented for the Commission to
restrict itself to holding regulatory hearings at a certain time of the year; no
town that he. is aware of does this. The Rivers protection section of the
regulations are particularly important and there is a number of great
loopholes in the State version that if not closed promptly will result in
environmental damage. He understood Mr. Lumsden's sentiments but people
do get the newspaper and are aware of what. is being covered here and he
would lie to proceed..
Mr. Lumsden stated that people who live on the water should have the right
to be heard; if they choose not to cone, that is another thing but they should
be given the chance.
The Chair also disagreed for the reason that there are the loopholes in the Act
that need to be addressed quickly. If the Commission waited for those who
live around the water to be able to attend, the Commission would be an
me 'ective board and only acting three months of the year.
