22 January 1995
Page 2.
Nir. Lumsden agreed, but asked if three months would make a huge
difference?
Steven BaH of the Watershed Management Committee asked that before the
regulations are adopted they go before the Management Committee this
coming Tuesday night. He 'would.tile therm to review then,
Mr. Sherman asked if he was asg that they not be adopted ung after the
Committee?s review He stated they could have been here tonight.
Mr. Ball stated he is also on the Board of Health and they had no input on
this regulation and did not even get a notice about this regulation.
Mr. Sherman stated it is posted and is in the office of the Town Clerk and
Selectmen. There is nothing here that affects their jurisdiction whatsoever.
Mr. Ball asked what harm there would be to let the Watershed Management
Committee look at this; is that not part of why they were formed?
Mr. Sherman stated it is an advisory committee and for the Comm ssion to
not adopt a regulation until certain boards clear it......Mr. Ball stated, just
postpone it. fir. Sherman stated he would life to act on there tonight, get
them in palace, go before his heard and take suggestions. There is no reason
why a hearing could not be held to modify therm. There are people coining in
right now with livers Act questions and misinterpretations and conflicts in
the way the language is written and he would life to get it cleared up. He
offered to appear before that board, take they suggestions for revisions and
any modifications could be made two weeks from now.
Perry Alis asked for a rundown of the loopholes and reserved comment for
after.
Mr. Sherman stated when the livers Protection Act was adopted by the
legislature, they wrote reqs that rewrote the whole Act. This was much to the
consternation of MACC. They have exempted certain activities from review
that used to require review: Unpaved pedestrian waways for private use,
they dont say how big they are or how high they can be; fencing, if it will not
constitute a barrier to wildlife movement, who makes that decision? Vista
pruning, without review, the Commission would not know it is going on.
