22 January 1998 <br /> Page 17. <br /> The Chair asked for a review of items outstanding. <br /> Certified slip for Wetlands Conservancy; Board of Appeals- Attestation of <br /> Ownership form; Certification that taxes are not owed on either property; <br /> revised fee sheet, state and local and cover letter to IEP with certified mail <br /> receipt, including trenching of electrical and water line; revised plan showing <br /> an improved walkover portion of the dock. <br /> The Chain stated the hearing can be' closed pending because those are all <br /> procedural issues. Mr. Sherman stated Mr. Hayes is aware the Commission <br /> cannot close until all items are received and this may be more than 21 days. <br /> Mr. Mayes advised he met with Ferry Ellis who helped him relocate the dock. <br /> It is known that the Brennans are bringing in a 22' Boston Whaler. They are <br /> aware that if they wish anything larger, they will have to get a mooring <br /> permit. Mr. Sherman stated it will be conditioned that the waterline of the <br /> propulsion unit cannot exceed the depth of the grater at Mean Low Water. <br /> VOTE: Motion made and seconded to close pending resolution of the items <br /> listed by the Agent. Unanimous Vote. <br /> The Agent advised lir. Mayes that concerning the South Cape g for Greg <br /> Taylor, it is still awaiting a plan. He suggested he could magic marker in to <br /> show where the nourishment is going. He was accosted by a DPW person the <br /> other night who asked shy he was picking on the DPW and why was he <br /> holding things up It is not him. - He does not like being yelled at in his <br /> private time. Mr. Bayes will get that plan right in. <br /> CLOSED PENDING. <br /> :50 CRAIG S. LYNCH to install a swimming pool within the buffer zone to <br /> a coastal bank and within land subject to flooding at 70 Popponesset Island <br /> Road. Any Bim, Jerry Carter and Craig Lynch presenting. Abutter <br /> notification receipts provided. A plan was reviewed. <br /> Ms Ball advised that in order to protect the adjacent property they put a <br /> siltation barrier between the construction area and resource area. In the <br /> Notice of Intent for the house, portions of the backyard were designated as <br /> natural area. Since the pool is encroaching into a portion of that area that <br /> was to be planted, they will add additional plantings in other areas on the <br /> northwest portion of the site. The net result will be a greater natural area. <br />
