22 January 1398 <br /> Page 7. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to find a negative determination. <br /> Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 7:30 MASHP E MARKETPLACE NOMINEE TRUST for site landscaping <br /> and buffer zone enhancement for a proposed commercial facility at 68, 74 <br /> Algonquin Ave., and 400 Nathan Highway and 657, 661 Old Barnstable <br /> Road. Michael Grote presenting. <br /> Mr. Sherman stated all issues have been resolved and have a plan, which in <br /> concept has been approved. The hearing could be closed and Order issued <br /> upon going over the language of the Conservation restriction, fine-tuning the <br /> revegetation pian and the lawyer accepting the language. <br /> Public comment: none. <br /> VOTE: lotion made and seconded to close subject to the Agent and <br /> Michael Grotzke going over the playas and ironing out any <br /> details and subject to the instrument being recorded. <br /> Unanimous vote. <br /> CLOSED PENDING. <br /> A group of people arrived after the hearing was closed who were interested in <br /> the outcome. The Agent reviewed the project for them. <br /> gentleman asked how far this improvement will go down? He advised he <br /> and his neighbors are from River Run. He described ars ori-going problem with <br /> kids going through the yards to jump over the creek and they throw trash <br /> around. The biggest problem is that they have been blocking the river off' <br /> Mr. Sherman stated he has seen this but the problem is he can't catch the <br /> perpetrator in the act. <br /> The man who had been speaking stated it would be mice if whe' <br /> cleaning up <br /> that land over there, they could extend the program a little further down. Mr. <br /> Sherman stated it was an offer on their part for a piece of property under <br /> their control and the Comml*ssion cannot mandate they do work on someone <br /> else's lot. He was asked if the town was doing this Mr. Sherman stated no, it <br /> is private. <br /> i <br />
