22 January 1995 <br /> Page 9, <br /> Would be put on the slope area where filed? Mr. Sanicki stated the entire lot <br /> is grass and they were going to regrass it. Requirements for lawns would be <br /> conditioned.. Mr. Sherman asked if there would be any objections and Mr. <br /> Sanicki stated there would not. <br /> Mr. Johan en stated there is no DEP number and a personal property tax <br /> goiLng back to 1995 is owed. Mr. Sar cki showed the Commission a receipt <br /> narked paid on January 2. <br /> Mr. Sherman read from Board-of Health comments that no plans were on fie. <br /> Mr. Sanicki stated plans were filed., Board of Health and Board of Appeals is <br /> necessary. <br /> Public comment: Michael Kelley, an abutter, showed a plan, indicating the <br /> location of his septic and stated there is 12" difference in the grade. He asked <br /> how high the elevation will change on this property as the drainage will go <br /> onto his property and he will have problems with his septic? His neighbors <br /> feel that way also. 1r. Sherman stated this does not come under the <br /> jurisdiction of the Commission; this should be brought to the Board of Health. <br /> Mr. Kelley stated his questions are to the regrading and bringing in 290 c. . o <br /> fill. Mr. Sherman stated the Board of Health retains total jurisdiction over <br /> septic systems. Mr. Kelley stated in the Notice it says the Commission is <br /> approving the regrading and asked if that is correct? Mr. Sherman stated yes. <br /> Mr. Kelley stated if approved, is it not his recourse to speak to the <br /> Commission about the problems it is going to be creating? <br /> Mr. Sherman stated under the stag act this area does not have any <br /> standards whatsoever so they can do whatever they wart. Under the town <br /> bylaw, for lands in the flood zone, it only deals with the amount of vegetation <br /> left on the lot and whether or not the fill would cause additional storm <br /> damage due to a tidal. surge. The Commission cannot issue until Board. of <br /> Health issues, <br /> Mr. Kelley asked Mr. Sanicki how high the elevation of this land will lie? Mr. <br /> Sanicki stated it will be ' at the foundation. Mr. Kelley asked how the grade <br /> will change at the property lines? Mr. Sanicki stated it will match into his <br /> grade. Mr. Kelley asked if there will he any provision for drainage? It will he <br /> similar to ghat it is there now. Mr. Sanicki was going to indicate they could <br /> put a French drain around the perimeter of the property. <br /> 'l'his discussion was continued outside, at the request of the Chairman. <br />
