it is a large scale, significant engineering structure on a steep <br /> slope. The Chairman and Commissioners agreed there was not <br /> sufficient detail on the plan presented by Ms. Fitzgibbon. <br /> Mr. Sherman recommended this matter be continued In order to <br /> provide Applicant the opportunity to provide an engineered plan <br /> to include construction details; and that the person responsible <br /> for construction of the stone retaining walls appear before the <br /> Commission at said continuance. <br /> The Chairman asked for any further comments from either the <br /> Conunission or members of the public. <br /> Mr. Green stated he was in agreement with the fact that an <br /> engineered plan is necessary in this matter. <br /> Mr. Sherman suggested the Commission deny the walls as <br /> presented, to permit the other structures, and request Applicant <br /> refile for a separate Notice of Intent and engineered plans for <br /> the stone retaining walls. <br /> MOTION: George Green made a Motion to deny the stone <br /> retaining walls; to accept amendments to the lawn, vegetable <br /> garden, asphalt driveway, garden shed, dog enclosure, and <br /> terraced walkway. To continue enforcement against the stare <br /> retaining walls, and that a subsequent filing for the walls <br /> be required, as well as an engineered plan. Said Motion was <br /> duly seconded by Ralph Shaw, and so voted unanimously. <br /> 8: 35 Cayuga one Realty Trust, of Ninety-Seven to install a <br /> new Title v septic system, remove existing asphalt paving, <br /> replace portion in kind and loam and seed portion- remove <br /> existing railroad tie wall, rebuild with pressure treated <br /> landscape ties and extend wall 5-feet, place20-cubic yards of <br /> sand fill and construct a garage at 68 Cayuga Avenue, Assessor' s <br /> Map , Block 1--dot ice of Intent. <br /> The Chairman recognized Mr. sanicki, who introduced himself <br /> as Dave Sanicki, Cape & Islands Engineering, representing Cayuga <br /> Trust . <br /> Mr. Sanicli stated there have been some minor revisions made <br /> to the plan, as requested by the Agent. Mr. Sanicki made <br /> reference to the plan, stating there is a new septic system in <br /> the front, he indicated the cess pool which has been approved by <br /> the Board of Health. He stated there is an existing paved <br /> driveway that runs to the water. He proposed removing the <br /> pavement from the edge of the water to opposite the front of the <br /> proposed garage and to repave a portion after construction of the <br /> septic system. <br /> Mr. Sanicki also indicated a sandy area/stall retaining wall <br /> which is used as a beach area. He requested permission to extend <br /> -13- <br />
