Mr._ S ierr an requested a decision be made regarding his <br /> response. He suggested he send his response strengthening the <br /> final paragraph as it relates to compensation for the 1998 crop. <br /> The general consensus from the Commissioners was in support <br /> of the Agentfs suggested amendment to his response. <br /> ; l John C. Power-47 Waterline Drive South, a continuance <br /> from January 8, 1998, Notice of Intent. Mr. Sherman reported <br /> that Michael Grotske is currently representing the Applicant and <br /> has requested a further continuance to April 2, 1998, at 7 : 30 <br /> p.m. , which request Mr. Sherman recommended the Commission <br /> accept . <br /> There being no comment from the public, the Chairman <br /> entertained a motion be made in this regard. <br /> MOTION: George Green made a Motion to continue the matter <br /> of John C. Lower to April 2, 1998, at 7 : 30 p.m. ; which lotion <br /> was duly seconded and so voted unanimously. <br /> 8 :25 Carl J. Davison, Tr. -91 Edgewater Road, a. continuance <br /> from February 5, 1998, Notice of Intent . Mr. Sherman reported <br /> the lawn, garden, asphalt driveway, garden shed, dog enclosure, <br /> terrace walkway, etc. are not issues, even though they were <br /> constructed without permitting, which was a atter of concern. <br /> At the Agent' s request, a. french drain system has been installed <br /> near the asphalt driveway. Mr. Sherman stated the area o <br /> concern is with the stone retaining walls. Because the walls <br /> were constructed without permitting, his concern is that they <br /> were not constructed correctly, which could cause therm to fail at <br /> some point . He has requested further details be provided. <br /> For the Record, Margaret Fitzgibbon stated she represents <br /> Carl Davison, Feinberg -Family Trust, as backers for construction <br /> mortgages for her building projects. MS.. Fitzgibbon made <br /> reference to a visual, indicating the side view of the foundation <br /> with no fill, the foundation that existed as constructed. She <br /> made reference to the embankment, stating a bank of silt fence <br /> had been created along both the left and right sides of the <br /> foundation. She stated construction had been done by Stewart <br /> Construction. <br /> Mr.. Sherman interjected at this point, stating he felt it <br /> was appalling that work of this scope had been dome without any <br /> contact having been made with the Conservation Commission. He <br /> further stated the plan presented by Ms. Fitzgibbon was <br /> insufficient. <br /> Mr. Sherman stated that had this project been presented in <br /> due course, an engineering plan would have been required. He <br /> suggested this matter not be considered any further this date and <br /> recommended an engineered plan for this structure be required a <br /> -12- <br />
