i <br /> i <br /> I <br /> MASHPEE CONSERVATION COMMISSION <br /> Minutes of 30 April 1938 <br /> Commissioners present; Elliot Rosenberg, Chair Pro Tenn, Ralph Shaw, <br /> John Johansen, Greg Wirsen. <br /> The Chair called the meeting to order and appointed,Associate Greg Wirsen <br /> voting member due to lack of quorum. <br /> 6:55 PUBLIC COMMENT PERIOD: None. <br /> :oo MASHPEEIWAKEBY POND LEVELS, continued from. 5 March 1998. <br /> Mr. Sherman advised Natural Heritage has provided a written response that <br /> is not favorable and expresses concern for a rare species. <br /> Mr. Rosenberg stated he and Mr. Sherman'attended the Selectmen's meeting <br /> and informed them the letter was coning and about the paragraph just read. <br /> Mr. Sherman informed them that, in the very least, there would have to be <br /> some very intensive investigation done and someone, not the Commission, <br /> would have to pay for i . <br /> Mr. Sherman felt it would be a conflict of interest for the Commission to fund � <br /> this. Mr. Rosenberg advised if they want to sit down with the Commission, <br /> we would be happy to do so, Mr. Sherman thought that would be <br /> meaningless; they will have to bite the bullet. If they want to pursue it <br /> further, it will not be easy to overcome N to al Heritage's qualms. <br /> Mr. Shaw asked who will spearhead this? It will be the Selectmen. Mr. <br /> Shaw agreed to attend any meeting with the Agent. Mr. Sherman stated if <br /> they dude to do the study, they have 21 days to readvertise the hearing, <br /> Mr. Shaw stated it bothers hien to leave it open ung then. Perhaps Bob <br /> Whriten.our should be asked to pick a reasonable time frame. Mr. Rosenberg <br /> questioned whether if stated that there is a time hm.it may ut the <br /> Commission in a position of having to deny the application. <br /> Mr. Sherman will write a letter that the Comission will follow 10.05 (5) (b) <br /> 3 to hold a public hearing publicized in accordance with the law upon the <br /> submission of a report on the affect on rare species, r upon the submission of <br /> a letter from the Selectmen that they do not wish to proceed, if that is their <br /> course. Mr. Sherman stated a decision has to be made tonight, Mr. Shaw <br /> stated if it has to be done tonight, he has nothing more to say. Mr. Sherman <br /> s* <br />
