The portion of the walkway above Mean High Water is not Chapter 91 and would subject to the 50°/fl surcharge. The portion below which is subject to Chapter 91, the Rivers Act dogs not apply. If the O'Rourkes wish to continue with this now, he would have to figure out the extra fees. If they wish to wait, a decision will be made in the next couple of months because Great River status has been challenged.
