Unanunnus Vote. <br /> NEGATIVE DETERMINATION. <br /> 7:25 WALTER HAY for a Determination of Applicability on a request to <br /> pump an existing cesspool and install a 1500 gallon septic tank and soil <br /> absorption system at 14 Tulip Shell Way. -Dave Sanicki presenting. They <br /> are voluntarily upgrading, it is not in failure at this time. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative. Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> ?:30 EDMUND C. 01ROURKE to construct and maintain a wooden pier, <br /> ramp and Haat at 34 Great diver Road. Mr. & Mrs. O'Rourke were present <br /> with Dave Sanic1d. Abutter receipts were provided. <br /> Mr. Sherman stated Great River may become "non-river", under the Act. The <br /> portion of the walkway above Mean High Water is not Chapter 91 and <br /> would subject to the 50°/fl surcharge. The portion below which is subject to <br /> Chapter 91, the Rivers Act dogs not apply. If the O'Rourkes wish to continue <br /> with this now, he would have to figure out the extra fees. If they wish to <br /> wait, a decision will be made in the next couple of months because Great <br /> River status has been challenged. <br /> Mr. Sard'cki stated if he and the Agent could adjust the fees, he would like to <br /> hold the hearing. They will take care of any additional fees. He advised the <br /> plan of record is dated 8/5f98. Revisions have been made at the request of <br /> the Harbormaster and then the Shellfish Warden. <br /> Mr. Fitzsimmons asked if the Harbormaster was made aware of the latest <br /> revision? The Agent will check. This doss not protrude any further out than <br /> adjacent docks. There will be a 10' ramp access, 160' fixed pier with a ramp <br /> i and float on the other end. The boat is a sail 18' Boson Whaler with a <br /> removable centerboard. Mr. Sherman asked if there is an outboard? NIx. <br />� O'Rourke sated a 5 hp. <br />
