f <br /> XASHPEE CONSERVATION COMMISSION <br /> Minutes of 4 February 1999 <br /> Commissioners present: John Fitzsimmons, John Johansen, George <br /> Green Jr., Ralph Shaw, Greg wirsen. <br /> The Chair called the meeting to order at 6;55 p.m. with a quorum present. <br /> 6:55 PUBLIC COMMENT PERIOD: No one came forward. <br /> The Agent suggested discussion of Item #1 under Old Business on the non- <br /> hearing agenda concerning the EIB remediation project. A letter was <br /> received from EOEA endorsing Town Counsel's concept of effectuating the <br /> lease. It may speed up reimbursement. <br /> The Agent advised the lease agreement should be signed tonight but not <br /> issued,until revised language is 'received. It has been approved by IEP, <br /> EDEA and Town Counsel. It is a temporary document that lets th.em keep <br /> going. Language re liability is to be provided. <br /> The Chair asked how this interacts with the negative easement lease? He <br /> was told both have to be approved at Town fleeting. The other was a <br /> temporary easement not to grow berries. He asked if this interacts with the <br /> fool being heard at 7:309. Mr. Sherman advised that under F, second page, <br /> that they must be in full compliance with all rules and regulations and the <br /> Order of Conditions. He also asked for cross references to the Commission's <br /> authority left out in one place. <br /> The Chair asked if this has to be agreed to by the military` It was noted they <br /> have to sign it and the selectmen also. It was agreed that the <br /> Commissioners take a moment at this time to read the agreement. <br /> The Chair felt the restriction of access to the site should be part of this. The <br /> Agent stated that would require return to Town Counsel for approval and he <br /> did not feel it had to be in this document. <br /> Mr. Green advised the site can be visited, there are no restrictions to the site, <br /> only in the general work areas where they require anyone to have 40 hours of <br /> OSHA training.
