F <br /> The Chair called for pudic con ent;there was none. <br /> VOTE: Motion made and seconded to close pendimg definition of the vier with the revised plan. <br /> Unanimous Vote. <br /> HEARING CLOSED PENDING. <br /> G. <br /> 7:40 MASHPEE HERRING WARDEN to dredge to remove periodic blockage of sand restricting the <br /> migration of herring to and from Mashpee Pond, 3 10 CNM 10.35 4 and 10.53 at Mashpee Wakeby <br /> Pond,Mashpee River and mill Pond. Mr. Johansen stepped down for this hearing as he assisted with the <br /> filing. The Chair appointed Mr. Con ry as a voting member for this hearing. <br /> Mr. Shenum reminded the Comiruission that four or five years ago there was a Notice of Intent to create the <br /> groins which have helped some in preventing the silting out of the mouth of the river. There is,however, <br /> some sand deposits that get into the flume itself and below the flume. The Division of Fisheries has asked <br /> us to address that because periodically they will need to be moved. It will enhance fisheries. It would be <br /> detrimental to fisheries who couldn't get thorn out in a drought year. This would be cleaning it flown to the <br /> concrete base and in front to the level of the concrete base. In other words,as far as we can get with a <br /> crane to make it even with the concrete base. Mr. Sherman recommended to close the hearing. <br /> The Chair called for public comment;there was none. <br /> VOTE: Motion made and seconded to close the hearing. Unanimous Vote. <br /> HEARING CLOSED. <br /> 7:45 CoRNELT TS FERRIS for a Detenrnination of Applicability for pruning acid maintenance of trees <br /> and plants at the rear and skies of the house at 38 Seconsett Point Road. Jeffrey Hamilton presenting. <br /> Mr. Sherman asked where most of the cutting was going to be done. Mr. Hamilton answered that they <br /> would be window pruning just to open things up so they can see the water. All around the house there is a <br /> lot of dead wood. <br /> Mr. Sherman asked Mr. Hamilton if he could add language to his permit so that for the work between the <br /> house and the water that they meet to go over it. N&.Hamilton agreed and he added to the permit that there <br /> would be a pre-work onsite meeting with the Conservation Agent. <br /> The Chair called for pubfic comment;there was none. <br /> VOTE: Motion made and seconded to find negative. Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 7:50 J-USTIN THOMAS to construct a single-family dwelling,driveway,well, septic system, landscaping <br /> and removal of a gravel pile adjacent to proposed construction and within the buffer zone at 28 Sampson's <br /> Mill Road. John Ellis presenting. <br /> Mr. Ellis stated this consists of two contiguous parcels of land constituting 6.89 acrcs as shown on <br /> Assessors Map,62,parcels 68 and GIA. The proposed house site has been designated as 28 Sarnpson's NO <br /> Road. It is bounded easterly by Mashpee Neck Road; on the north by land of Marjorie Jordan and on the <br /> west by land of John Thomas. <br /> The dominant feature of the site are a series of overgrown cranberry bogs and ditches. The proposed home <br /> construction is at its closest point 52 feet from the wetland and 53 feet from the 50 foot buffer from the <br />
