Ir. Johansen told Mr. Bennett that we would reed the gireen and white cards. Also,there are real estate <br /> taxes due for 1998. Mr. Sher xan stated that under TownBy-law, we cannot give a p nrdt when there are <br /> taxes. It has to be settled with the Torn Treasurer. <br /> Mr. Green stated that we would also need specifications on the tanks and the piping that they are changing. <br /> Mr. Bennett asked if that was prior to-the removal of the vessel. Nfr. Green said we would need at least the <br /> specs. Mr.Bennett said he was hoping the omrnis ion would extend some latitude because of the back <br /> log uh the orders and the fact that they are replacing the facility in the same place that it is currently by <br /> making a contingency as subject to the FireDepartment's approval of the plan. He went on to say that they <br /> are now beyond the f eccmber 22 deadline in a position to whore they want to get the tank out of the <br /> ground to be in compliance. There is a certain period oftime that runs from December 22 that they have t <br /> pull the tarts out of the ground. Subject to the real estate taxes bring taken care of, Mr.Bennett was <br /> hoping to pull the tank out of the ground and maybe continue the hearing until which time they had the <br /> Plans. Mr. Bennett stated they would not be doing the installation right away. <br /> Mr. Bennett went on to say that he has represented a IU-Mit of work with silt fearing as well as made notes <br /> n the plans as to the perfor'mance of the job. The job would take approNlimately four hours worth of bine. <br /> They will be on site to do the testing and so they could back those trenches immediately and get the <br /> material back in the ground within twenty-four hours of the time the tank is pulled. <br /> Mr. Sherman asked Mr.Bennett what his timetable to get the tank out was. Mr.Bennett answered they had <br /> the work tentatively scheduled for a week from tonight. hili. Sherman explained that would be a little hard <br /> to do. He stated there is a ten day appeal period even if we could issue a penrait tomorrow. Mr. Sherman <br /> then wanted to-know if we did issue the permit tomorrow, would we then amend it for the revised plan'With <br /> the specs, or could we just condition it that it will have to be according to building code specs. lam. Green <br /> said we could condition that. Mr. hernxan went on to say that he still could not have the permit issued <br /> before Tuesday afternoon and then there is a ten business clay appeal from the date of issuance. <br /> Mr.Bennett said he would like to schedule a meeting to go in front of the Commission again before the <br /> actually put-it in the ground. Mr. Sherman and Mr. Green agreed that we could just condition that also. <br /> Mr. Sherman said that the tax problem still needed to be taken care of. Mr. Scozzari said that he thought <br /> the tax problem was taken care of but he would double-check. If that is the case,Mr. Shenmn stated we <br /> could just condition there be another meeting to.review the specs and condition everything will be <br /> according to code. <br /> The Chair called for public comment;there was none. <br /> VOTE: Motion grade and seconded to close ponding resolution of the tax question with the stated <br /> conditions. Unanimous Vote. <br /> HEARING CLOSED PENDING. <br /> 7:35 MARTIN CUSACK for vista pruning and vegetative maintenance in accordance with Town of <br /> Ma hp (Management options within a naturally vegetated buffer strip,dated4/2/98)at 42 Quail Hollow <br /> Road. 1r. Johansen stepped down for this hearing as he assisted with the filing. The Chair appointed Mr. <br /> onery as a voting member for this hearing. <br /> Patrick Ball,was presenting. Mr.Ball stated that Nlartin Cusack,who is the applicant,lives in the house <br /> next boor. There is no house on the lot that Michael Cusack owns. They have a window on the sick of <br /> their house and they just want to get a better view of John's Pond. They would.like to get a little hit of <br /> trimming clone and lirnbs pruned a little so they can get a better view. <br /> Mr. Sherman explained that the vista pruning guidelinc call for a 25%view because it cannot be all the way <br /> across. That is not defined on the plan at this point. lir. Shennan suggested that the Commission Grote to <br /> issuc subject to Mr. Sherman and Mr. Ball defining the %view. <br /> 3 <br />
