so they are going to be specifying float stops. There are some additional issues that are involved and <br /> feedback from National Heritage,that there has been some freshwater eel in the area. They are endangered <br /> in Massachusetts. Mr. Grotzke stated that the site needs to be looked at in greater detail to determine <br /> exactly what the eel presence is and if there is any habitat. llrlr, Sherman asked that hero be some <br /> differentiation between freshwater wetland and salt marsh that should be shown. we would also need <br /> analysis by a qualified person on the impacts of the brook lamprey. <br /> Mr. Johansen asked if there should have been some fees for the rlverfront area. Mr. Grotzke was not sure <br /> that applied to deeps. Mr. Sherman explained that it does. He said anytWng that is above mean high water <br /> it does apply. Mr. Grotzke said that would be addressed. <br /> Mr. Shemian also stated we would need a little more construction detail on the dock. Mr. Grotzke said that <br /> would also be addressed. <br /> The Chair called for public comment-,there was none. <br /> VOTE: Motion made and seconded to continue to App 8, 1999 at 7-:30 p.m. Unanimous Vote. <br /> HEARING CONTINUED TO APRH 8,1999. <br /> 7:25 MARY BURKE for Determination of applicability on proposed restoration of natural plants and <br /> grasses;removal of all lawn;addition of beach sand and natural grasses; rebuilding of an existing deck and <br /> facing of railroad tie walls with natural stone at 22 Triton way. Tom O'Neil presenting. <br /> Mr. O'Neil stated that right new they have landscaped up to in front of the property. They removed all of <br /> the lawn and put hz natural stone walls. They used natural plants. They are planning to do the salve for the <br /> hack. The back right now is lawn and landscape timbers. There is a shuffleboard court. 1&- Grcen asked <br /> if they were pressure treated timbers. Mx. O'Neil stated they were pressure treated. Right now, they had <br /> landscaped this in the original fashion. After Hurricane Bob, they had gotten an Emergency Order. They <br /> had it re-landscaped the way it was done 40 years ago. However,right now, it looks like a miniature golf <br /> course. There are a lot of tiers and red brick. They plan to mance it look natural. Mr. O'Neil went on to say <br /> they landscaped for the community the beach access next door. They intend to make this very subdued and <br /> Mural. <br /> The Chair called for public comment;there was none. <br /> VOTE: Notion made and seconded to find negative. Unanimous dote. <br /> LEGATIVE DETERMINATION. <br /> 7:30 ROBERT SCOZZARI for removal of UST and associated piping,within a resource area,to be <br /> replaced with double walled tank and piping as subject to Mas pec Fire Dept. permits and licenses at 20 <br /> Frog Pond dose Road. David Bennett presenting on behalf of Tim and Robert Scozzari. <br /> Mr. Bennett stated he has met with Mr. Sherman at the site on several of occasions and discussed this <br /> project. The project is being necessitated by some upgrade requirements for underground storage tanks. <br /> The proponent has abandoned this tank from service as ofDecember 22 and all the contents were pumped <br /> out of the tank and the tank was inerted. As part of the work that they are doing for the mar . ,they are <br /> designing a double walled tank with interstitial rnoratoring to meet the new standards. He had also done a <br /> preliminary boring there to bring before the Commission whether or not this site was going to be <br /> complicated by any type of remedial response action. From the borings that they have dome, it does not <br /> appear there have been any leakages at the site. Because of a hack order in talcs and equipment, his firm <br /> has not developed the detailed plans for the facility at this point. However, the lines will be replaced in the <br /> same trench with which they are going to be pulled and the tank will be going back to the same location <br /> from where it came. <br />
