VT'B: Motion made and seconded to close pending revised plan.-Unanimous Vote. <br /> CLOSED PENDING. <br /> 8.10 FRED GLASS to construct a single family dwelling,garage,utility services and Title V Septic <br /> System at 133 Tide Run. Mr. Slavinsky presenting. <br /> Mr. Slavinsky stated he made a mistake. He said he made the assumption that it was the marsh. It is not. <br /> It is elevation 10. Zoning by-law says a dwelling has to be set back 5' from the ACEC. He went on to <br /> say that obviously they cannot do that. He stated they are filing with the Board of Appeals. He believes <br /> they are maintaining a 5 'buffer from the top ofthe bank on than particular lot. They have a d nitriled <br /> system. They are inside the lot coverage as rcquired by zoning. They are not looking for anything outside <br /> a work limit. He believes the work line can be a little closer to the house than in a normal situation because <br /> basically it is a frost wall. It is going to be a trench. The Building Department will demand that the bottom <br /> of the crawl space be at the level of the lowest section of the lot. So,Mr. Slavinsky said-they are going to <br /> put a one foot trench along the closest perimeter. The frost wall will be going down ' and there will not be <br /> a foundation because they are not allowed to do that anymore. Mr. Slavinsky said he realizes he has to go <br /> to the Burd of Appeals and he will not be able to get an answer tonight. <br /> w <br /> Mr. Sherman agreed. He said the hearing would have to be continued until the Beard of Appeals has made <br /> a decision. <br /> Mr. Slavinsky asked what they thought about a setback and the work limit. Mir. MCCONNELL for construction of a house, garage and deck within the 100' buffer to a <br /> coastal bank at 7 Harbor Ridge Drive, Dave Sanicki presenting. <br /> Mr. Sanicki said that Harbor Ridge Drive is off`of Great Neck South. 'There was a presentation on <br /> subdividers and this DPW was defined on the initial plan. They are showing the same DPW as the <br /> Commission approved. They then did an independent typographic survey and located the elevation of the <br /> flood zone. Based on that,they are proposing a buffer strip inland 54'and 5 3 3 from the top of the bank to <br /> the work Bruits. The leaching facility is set back 202' from the top of the bank which is outside the <br /> jurisdiction. Thus,there is no renitrof"rcation proposed. <br /> Mr. Sherman stated that Diane Boretos noticed a few snags that she would like to keep. <br /> The Chair called for public comment;there was none. <br />
