Creeden stated at some point in the future, with a permit issued it is <br /> going to be done. <br /> The Chair stated that is outside of the Commission's ,jurisdiction. If the <br /> applicant wishes, they can strike from the plan that portion shoving the <br /> drain and sign and date it. <br /> Mr. Sherman felt it-would be legitimate to add to the request, as previously <br /> discussed, that before the work there will be an on-site meeting to discuss <br /> plantings. That would be within the scope of the work. <br /> Ken Bates of Popponesset Beach Association stated, based on discussions, <br /> and of going down the road together to work on the project, he lid not <br /> understand why they have to pursue the approval of this plan as amended. <br /> He left the meeting Tuesday with an objective of having a follow-up meeting <br /> when it is seen what transpires 'in the area with the new no parking <br /> enforcement signs being posted and in the spirit of cooperation of terga <br /> placing the disposal barrel, things that do not really affect this Board. He <br /> suggested holding off on thi§ until October, see what obstacles exist andre- <br /> submit it then. He is requesting that the applicant withdraw the application. <br /> The Chair stated unless the applicant indicates a withdrawal of the plan, the <br /> Commission is required to act on it. <br /> Mr. Bates asked, should the Commission approve the plan and the <br /> Commonwealth or the Town go ahead and increase the scope of parking on <br /> the lot as indicated on the revised plan, what is the notification for the <br /> abutters' The Chair stated it is none, there is no legal requirement. <br /> 1lr. Cameron stated the Commission is in a position to approve the parking <br /> spaces which isn't a concern for him. what is more of a concern is having a <br /> agreement and working relationship with Popponesset Beach Association in <br /> solving some of the problems that are down there. <br /> The Chair stated that is between Fish & wildlife and the Association. <br /> VOTE: Motion made and seconded to find negative. Unanimous vote. <br /> NEGATIVE DETERMINATION WITH REMOVAL of THE DRAIN. <br />
