April 1339 <br /> Page 2. <br /> 7:05 HASHPEE HARBORMASTER,R, 236 Wading Place, continued from <br /> March 1999. Perry Ellis advised most of the problems have been worked out. <br /> He asked the Commission to rule on what is before there. There is a new <br /> plan with the drainage proposed, still 80 feet from.the top of the bank. <br /> Mr. Sherman stated there are no performance standards under 131.40 and it <br /> meets all standards under the bylaw. The Commission has no problems with <br /> the plan. <br /> Public comment: Atty. Dan Creeden spoke on behalf ofthe Popponesset <br /> Beach Association. <br /> The Chair pointed out the Commission's jurisdiction is limited to issues the <br /> I <br /> Agent raised. <br /> Atty. Creeden stated he would like to see his client, the applicant and the <br /> State working from a position of cooperation. There was a meeting here two <br /> nights ago when it was represented in no uncertain terms that the applicant <br /> was no longer seeking to install the four parking spots on the plan. <br /> Mr. Ellis stated at the previous meeting, he was asked to move the parking <br /> spaces out of the road layout. He is not building the parking spaces, just <br /> getting the permit. <br /> Doug Cameron of the State Public Access Board stated they are not looking to <br /> do anything at this moment and will have discussions with the Association as <br /> to how to proceed. Besides the potential for additional parking, they would <br /> like to have on the table the hours that it will be open to the fishermen for <br /> access. <br /> The Chair stated all the Commission will decide is whether or not there i <br /> any violation of any statutes, bylaws or regulations, over which they have <br /> control. If there i no violation, the Commission does not have the authority <br /> to deny the project. <br /> Atty. Creeden stated, as a point Of procedure, there has been an amended <br /> • plan and this may require a whole new filing. <br /> Mr. Sherman stated there would be a three year window to do the project. If <br /> they want to take the drain out and let it go as is, it can be approved. <br />
