April 1999
Page ' .
7:50 JAMES HINNY for a Determination of Applicability on a request to
repair/upgrade an existing failed septic system to Title V system, remove an
existing cedar tree and placement of a sail absorption system at 141 Shore
Drive. Ed Pesce was present.
Mr. Sherman did not have a problem with the septic but Diane Boretos found
the wetland line to be incorrect. Also, the owners had been mowing an
herbaceous layer for some time. The new line to be memorialized with
shrubs. Cedar trees have habitat value, cutting thein down would
compromise wildlife value.
Mr. Pesce asked if they could relocate the tree to the wetland lime. They
could move it to the side lime. This has been before the board of Health and
pssed.
Mr. Sherman suggested deleting the tree from the request for now and filing
for it later for the tree.
Mr. Pesce requested a two week continuance.
Mr. Sherman stated Board of Health needs revised plans.
Mr. Johansen question whether this should be a Notice of Intent.
Mr. Sherman stated it is the only tree there. He would not object to
relocating it.
Mr. Green stated an 18" cedar is going to be very expensive. It would be hard
to move and have it survive. Mr. Sherman stated a report from an arborist
would be necessary.
Mr. Pesce stated he would like to agree tonight to delineate the BVW line
with blueberry shrubbery and delete removal of the tree.
Public comment: none.
VOTE: Motion made and seconded to find negative pending conditions
stated, removal of the cedar tree from the application and board
of Health approval. Unanimous vote.
NEGATIVE PENDING, ,
