22 April 1999
Page 6.
Board of Appeals and their attitude was that there was nothing they could do
to grant a variance from ACC without some input from Conservation and
need a memo that this is within the guidelines.
Mr. Sherman stated he had a conversation with Jamie Regan and tela him
this. They make the o' and there should be no problem tinder the local
bylaw. Faxes from neighbors, Mark and Susana Gorstein were read into the
record by the vice Chair. Mr. Slainsly stated they withdrew the variance
request. Mr. Sherman stated some points in the letter are relative to some
degree. He offered to communicate to the Board of Appeals that it would be
better environmentally to leave some natural vegetated buffer but it cannot
be required. The Notice of Intent per se did net specifically mention
landscaping so none is approved at this time.
The Chair suggested M's Lannik tale this up with the Architectural ,evie'w
Committee as it is not the Commis ion's affair.
Mr. Johansen noted the Notice does not mention ACEC. To be revised.
Mr. Rosenberg stated the plan does not show it, but asked if the second story
of the garage is going to be heated and usable? Mr. Slavins y stated he does
not know where Ms Lannik is getting the two-story information.
Mr. Sherman stated it will be conditioned four bedrooms and what is
considered a bedroom.
11r. Slavinsy stated the board of Appeals did say to cut down the front of
the house to the 30' setback,, which they dial. They did maintain the o'
buffer. There is-a denitrifying system.
Public comment: none.
VOTE: Motion made and seconded to close pending Board of Appeals
approval and correction of the reference to ACC added to the
appropriate page of the Notice of Intent. Unanimous vote.
CLOSED P NDING0
7:35 BRIAN D. CASEY to remove one pitch pine tree and to do pruning and
thinning at 57 birch way.
