May 1999 <br /> Page 12. <br /> letter was received concerning the mitigation plan. Mr. Sherman called <br /> Nancy Balkus and was told this letter is their pledge to do this. Their intent <br /> is to have the plantings done 1 June 1999. A revised plan was given to Tim <br /> Snyder specifying size and density. The Commission agreed this was <br /> satisfactory. <br /> Concerning monitoring and who is going to be in charge, he suggested to <br /> them that Frank Leblanc be given some authority in terms of replanting. <br /> Mr. Sherman advised they asked to build a temporary access road to K1. <br /> They had to take don three trees but pledged to restore them after. He <br /> conferred with John Johansen and gave them the okay. <br /> Bog Subcommittee: John Johansen advised he spoke with Brian Mandy and <br /> learned he was concerned with item #2, Assumption of responsibility. Brian <br /> is providing a copy of Falmouth's lease as he would like something from <br /> Mashpee along the same lines, if it goes down to three or four years. <br /> The Commission was in agreement to look at plans for what will be done with <br /> the money when the legislature gets around to it. It was agreed the money <br /> should not be spent but held as it may be the last for crops. Mr. Sherman <br /> stated it should be spent on the redesign of the John's Fond flume because it <br /> is vital for the herring. <br /> Minutes: Motion made and seconded to accept the minutes of January 7, <br /> January 21, February 4, March 4, March 17, and March 18, 1999 <br /> as written. Unanimous vote. <br /> Article 29; Mr. Sherman advised there was a disturbing failure on the Tax <br /> Title Land article for lands that abut Conservation lands. It wiled to pass <br /> because Dan Homeyer got into previous concerns he alleged were promised in <br /> the original write-exp of the John's Pond agreement. The Agent made it clear <br /> they were not in keeping with low impact uses. Nancy Caffyn thea made a <br /> motion to indefinitely postpone. An attempt was made to reopen it the next <br /> might but it was defeated. It will have to be brought up again but people will <br /> have to be convinced Dan's comments are not relevant. <br /> Assistant Agent: The full-time position was accepted. The only way that <br /> this could be dome was to use Conservation land money and pledge her for a <br /> day and one-half per week working on Conservation land issues. It only <br /> means she will be available for enforcement, permitting and other things for <br /> an additional mine hours. <br />
