4 20 May 1339 Page 1 . The Chair stated someone must be taxes on this property. It must be some kind ofreserved land or a trust. Mr. Olsen thought it was part of a trust of Mr. Labute. The Chair stated the Commission has to address the environmental issues and cannot be concerned about whether or not it is appropriate to have a beach there. Mr. Olsen stated it is his intention to make this a very+beautiful place for his children to play in. They are very young and he wants a safe place. He will beautify the place more than make it a detriment. Robert spousta, an abutter, spoke in support of what Mr. Olsen is trying to d . He asked if there is a question of ownership of the land because it is the end of the street. Mr. Sherman stated there is a question but it is not germane to these proceedings. The Chair stated if someone wants to complain about something that is being done on this land, someone i paying taxes on this land. Ms Madden asked if it was not true that because this is waterfront, within half the road to the water, that it is public access Mr. Sherman stated he has gone to the Beard of Assessors and there is no clear answer. she stated thea people can do just whatever they please. Mr. Sherman stated under a Request for Determination of Applicability, the Commission cannot deny request because ownership is unclear. They can only deny if it abrogates the standards of the wetlands Act or the local bylaw. VOTE: Motion n made and seconded to find negative pending the Agent's review. Unanimous vote.
