4 <br /> 20 May 1339 <br /> Page 1 . <br /> The Chair stated someone must be taxes on this property. It must be some <br /> kind ofreserved land or a trust. Mr. Olsen thought it was part of a trust of <br /> Mr. Labute. <br /> The Chair stated the Commission has to address the environmental issues <br /> and cannot be concerned about whether or not it is appropriate to have a <br /> beach there. <br /> Mr. Olsen stated it is his intention to make this a very+beautiful place for his <br /> children to play in. They are very young and he wants a safe place. He will <br /> beautify the place more than make it a detriment. <br /> Robert spousta, an abutter, spoke in support of what Mr. Olsen is trying to <br /> d . He asked if there is a question of ownership of the land because it is the <br /> end of the street. Mr. Sherman stated there is a question but it is not <br /> germane to these proceedings. <br /> The Chair stated if someone wants to complain about something that is being <br /> done on this land, someone i paying taxes on this land. <br /> Ms Madden asked if it was not true that because this is waterfront, within <br /> half the road to the water, that it is public access Mr. Sherman stated he <br /> has gone to the Beard of Assessors and there is no clear answer. she stated <br /> thea people can do just whatever they please. Mr. Sherman stated under a <br /> Request for Determination of Applicability, the Commission cannot deny <br /> request because ownership is unclear. They can only deny if it abrogates the <br /> standards of the wetlands Act or the local bylaw. <br /> VOTE: Motion n made and seconded to find negative pending the Agent's <br /> review. Unanimous vote. <br /> NEGATIVE PENDING, <br /> 7:35 DANIEL CANDU A for a Determination of Applicability on the <br /> expansion of ars existing deck and addition of stairs for egress at 74 Fells <br /> Pond Road.. Mr. Sherman advised Diane Boretos did theon-site and <br /> recommended replacing a shrub. Plans do not show distances to the resource <br /> area. <br /> Public comment:ent: none. <br />
