Mr. Sherman advised Natural Heritage has concurred <br /> with the plan. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to close the hearing. Unanimous vote. <br /> HEARING CLOSED. <br /> 7:45 CSL DEVELOPMENT Co., 113 Popponesset Island Road, continued <br /> from 6 May 1999. Array Ball presenting with Atty. Jeremy Carter. Atty. <br /> Carter stated they were told to revise the plan. They met with the Agent and <br /> have relocated the pool completely. <br /> 1Ir.,Sherman stated the revised plan is much better but he still has concerns. <br /> Based on present policies, ' if this were new construction, it would be <br /> unpermittable. He asked if they were going no further than what is <br /> currently there? Because of the proximity of the pool apron to the top of the <br /> bank, there is still a potential runoff problem. He wanted to see if they could <br /> reorient or reconfigure the pool to get at least a row of screening vegetation. <br /> Ms Ball stated they have dome that. He asked if the apron was over the <br /> bank? A portion of it is. He asked if the apron is being graded away from the <br /> bank so there 'is no runoff over the bank? Ms Ball stated it could be. <br /> Secondly, he asked, could screening vegetation be placed continuously, like <br /> junipers? Ms Ball stated she could add more vegetation. Proposed now is F <br /> junipers and bayberry. Mr. Carter asked what would be required for proof of <br /> the grading. Mr. Sherman stated cross section of a pool plan shoring that <br /> it is grading away. <br /> Mr. Wollenhaupt asked if they were getting rid of the stair beach access <br /> completely? Ms Ball stated actually there are no stairs. Mr. Carter stated <br /> that was a proposal. Mr. Sherman stated it probably would be better to add <br /> some stairs down the bank. It will be conditioned that within six months <br /> they will file an amended order for stain. Ms Ball agreed. <br /> 2 <br />
