MASHPEE CONSERVATION vATION COMMISSION <br /> Minutes of 3 June 1999 <br /> Commissioners present; Elliot Rosenberg, Chair Pro Tens, John Johansen, <br /> Tad Wollenhaupt, Perry Ellis, Ralph Shaw,... <br /> George Green Jr. arrived at 8:00 p.m. <br /> The Public Hearing scheduled for 6:40 p.m. is to be held on 17 June 1399. <br /> The Chair called the meeting to order at 6:55 with a quorum present. <br /> 6:55 PUBLIC COMMENT: Dorman Hares of BSC cane forward to request <br /> action on a letter submitted requesting a waiver for the 10,000 c.y. o <br /> nourishment at 1 aushop. The annual report was submitted and the criteria <br /> is that if they meet either the '89 or '95 profile with x amount of <br /> nourishment, the Commission can forego the remaining amounts. They have <br /> dome that. He asked for the waiver in writing. They matched the '95 profile <br /> and did not put in the 13,000, they put in 4,000. Cape Cod Commission <br /> requires that they put down 2,650 minimum. This Commission requires that <br /> they match the '83 or '95 profile, whichever is greater. <br /> Mr. Sherman recommended granting the waiver as it would be unfair to <br /> impose that standard on them when they have done as much as. they have. <br /> There are a lot of people up and down the coast that are not doing anything. <br /> He has spoken to DEP and a meeting in Lakeville wIll be scheduled with Jinn <br /> Mahala, Mr. Mayes as representative of several clients and Aubrey. There <br /> ill be an accounting of who is in arrears. Hopefully, DEP is going to take <br /> some action. <br /> VOTE: Motion made and seconded to grant the waiver as requested. <br /> Unanimous Vote. <br /> Secondly, Mr. Hayes stated, on behalf of Maushop Trustees, they are <br /> concerned about orders of Conditions for people about to repair revetments <br /> and that they be advised they have to get written authorization to pass over <br /> i laushop beaches. <br /> Mr. Sherman dict net feel this could be conditioned and the order of <br /> r Conditions cannot grant access rights. <br /> Mr. Rosenberg stated it is a trespass situation and up to other authorities. <br /> Mr. Hayes stated they are alerting the Commission that they expect other <br /> people above llaushop to use the same protocol that they use when they <br /> establish the access to l aushop when they do construction. <br />
