i
MASHPEE CONSERVATION MMi Si N
Minutes of 15 July 1999
Commissionerspresent: John Fitzsimmons, Chairman, Elliot Rosenberg,Ralph Shaw,John Johansen,
George Greer,Jr.,Tact Wollenhaupt,James Conery,Jr.
The Chairman opened the meeting for public comment. There being no one present from the public
wishing to comment, the Chairman opened the meeting to non-hearing business.
1 There is a serious problem with people on Triton Way who have not kept up with their beach
nourishment requirement as part of the conditions,at least six individuals, some represented by
Aubrey Consulting and some by Norm Nays ofBSC. Dorm Hayes has given us a letter from
Mushop people who have been doing their beach nourishment and they are troubled that others are
not. They are threatening to withhold access. I have a commitment from DEP that in late August we
will have a meeting(probably the 27 Ih between New Seabury,BSC and Aubrey to talk about these
issues as well as the regional beach nourishment program that we are working on that would integrate
everyone into one condition. I have gotten a conu-nitin nt from DEP that they will enforce either the
previous orders or they will come up with a regional plan.
Mr.Fit sin noes advised the New manager of New Seabur ,over the fourth of July weekend
mentioned there were vehicles on the beach, one of vwhich got stuck. Do we have any problems with
vehicles on that beach?
Mr. Sherman stated yes, town by-law prohibits it. When they get into Sandy Beach,he's proposing to
put up some fences. I think Grotzke is going to get in touch with you.
2 Mr. Sherman stated,as you know, we have had problems with various consultants who are not
preparing proper plans, not following our submittal requirements and I told you I would write a memo
(occasioned by two deficient filings that came in tonight). He distributed a copy of the letter he is
proposing to send out for comment by the Commissioners. I will recommend that we deny if they
don't have the property staked,or if they have work shown in section 3B and it is not listed in the
plan.. We are taring to prevent premature hearings which will often result in multiple requests for a
continuance when the proper materials are not ready.
VOTE: Motion made and seconded to send out the letter outlined above. Unanimous vote.
7:05 SALVATORE MACERA for Determination of Applicability on the replacement of a railroad tie
retaining wall with stone retaining wall in the same footprint at 26 Little Neck Lane,Assessors Map 105,
Block 9. The wall is on the street side of a coastal bank on the other side of the road. The work was
already begun before they realized they needed a permit. We asked therm to stop work until they had a
permit and they were very cooperative.
Public connent: none.
VOTE: Motion made and seconded to find negative. Unanimous vote.
NEGATIVE T 1 NH TION.
Return to Old business:
We have filed several articles for Town meeting in the fall, one of which was the one turned down at
Town Meeting transferring tax title land to the Conunission. This will be resubmitted. In the future
we should be ready for Town Meeting in a more organized fashion. Another article mirrors the
