11IASHPEE CONSERVATION COMMSSION Minutes of 29.Tiny 1999 Commissioners present: John Fitzsimmons,Elliot Rosenberg,John Johansen, George Green,Jr. and Greg Wixsen. The Chair called the meeting to order at 6:55 p.m.know what time)with a quorum present. Mr.Fitzsimmons reads an important notice regarding a change in the scheduled hearings due to improper legal notice. There will be no public comment hearings. Norman Hayes was present at the request of his client Mr. Jacobson for a certificate of compliance. H stated, assurming nothing is wrong at the inspections,the only outstanding issue is the most recent order of conditions that had a requirement for beach nourishment to be done every Fall. This has not been done yet. Many residents on Triton Way have defaulted on their beach nourishment or reporting. Given that, it i prudent to receive an acknowledgment from the new buyers that they will be subject to a continuing requirement for beach nourishment and reporting. Mr. Sherman advised the new owner plans to provide a letter of agreement and the orders can be released as soon as we receive a hard copy of the letter and satisfactory inspections are complete. Discussion re regional nourishment plan with the DEP and enforcement. There is general agreement that diose who are living up to the standards of nourishment and reporting should not be disadvantaged by those who are not by allowing access to the beach through their properties. Mr.Hayes will provide a complete listing at the August 13 meeting with DEP of those residents in compliance and those who are i not. i Concerning the nourishment at Maushop, is there any precedent involved? Mr. Hayes stated t here could be,because the Conservation Conunission,the Cape Cod Commission and LBP have required ilriaushop to meet very stringent standards. Those same standards being met by Maushop have been imposed on other properties nearby and have not been met. Therefore,the standard data we will need will not be there. Mr. Sherman advised no formal l en or ement proceedings have been issued because Aubrey Consulting and BSC have been working on a regional concept taking offshore sediments aimed at a large nourishment. This cannot be done piecemeal. Mr.Rosenberg asked what assurance we have that these people in default will attend the Aug. 13 meeting? Mr. Sherman stated they don't aced to. We just want IABP to take some enforcement action. 7:05 MAUREEN QUINLAN must be postponed due to Notice error. VOTE: Motion made and seconded be continued to 12 August 1999 at 7:30 p.m. Unanimous vote. Old Business: 1 e offer of land made lir Mr. Collins at the corner of Sunset Circle, the Commission should make a► decision at this meeting to tape the land that would give access to Johns Pond. VOTE: Motion made and seconded to accept the offer. Unanimous vote. 7:10 JOSEPH M.BIKNAI T IS continued from 15 July 1999. Johnlavinsky from Cape and Islands representing. Mr. Biknaitis wishes to build a 2 bedroom house on the property. IIIc. Sherman stated staking is accurate as well as wetland identification. It meets performance standards under the act and by-laver.
