11IASHPEE CONSERVATION COMMSSION <br /> Minutes of 29.Tiny 1999 <br /> Commissioners present: John Fitzsimmons,Elliot Rosenberg,John Johansen, George Green,Jr. and <br /> Greg Wixsen. <br /> The Chair called the meeting to order at 6:55 p.m.know what time)with a quorum present. <br /> Mr.Fitzsimmons reads an important notice regarding a change in the scheduled hearings due to improper <br /> legal notice. There will be no public comment hearings. <br /> Norman Hayes was present at the request of his client Mr. Jacobson for a certificate of compliance. H <br /> stated, assurming nothing is wrong at the inspections,the only outstanding issue is the most recent order of <br /> conditions that had a requirement for beach nourishment to be done every Fall. This has not been done yet. <br /> Many residents on Triton Way have defaulted on their beach nourishment or reporting. Given that, it i <br /> prudent to receive an acknowledgment from the new buyers that they will be subject to a continuing <br /> requirement for beach nourishment and reporting. <br /> Mr. Sherman advised the new owner plans to provide a letter of agreement and the orders can be released <br /> as soon as we receive a hard copy of the letter and satisfactory inspections are complete. <br /> Discussion re regional nourishment plan with the DEP and enforcement. There is general agreement that <br /> diose who are living up to the standards of nourishment and reporting should not be disadvantaged by <br /> those who are not by allowing access to the beach through their properties. Mr.Hayes will provide a <br /> complete listing at the August 13 meeting with DEP of those residents in compliance and those who are <br /> i not. <br /> i Concerning the nourishment at Maushop, is there any precedent involved? Mr. Hayes stated t here could <br /> be,because the Conservation Conunission,the Cape Cod Commission and LBP have required ilriaushop to <br /> meet very stringent standards. Those same standards being met by Maushop have been imposed on other <br /> properties nearby and have not been met. Therefore,the standard data we will need will not be there. <br /> Mr. Sherman advised no formal l en or ement proceedings have been issued because Aubrey Consulting <br /> and BSC have been working on a regional concept taking offshore sediments aimed at a large nourishment. <br /> This cannot be done piecemeal. Mr.Rosenberg asked what assurance we have that these people in default <br /> will attend the Aug. 13 meeting? Mr. Sherman stated they don't aced to. We just want IABP to take some <br /> enforcement action. <br /> 7:05 MAUREEN QUINLAN must be postponed due to Notice error. <br /> VOTE: Motion made and seconded be continued to 12 August 1999 at 7:30 p.m. Unanimous vote. <br /> Old Business: <br /> 1 e offer of land made lir Mr. Collins at the corner of Sunset Circle, the Commission should make a► <br /> decision at this meeting to tape the land that would give access to Johns Pond. <br /> VOTE: Motion made and seconded to accept the offer.
