MA HPEE CONSERVATION COMMS ION Minutes of 12 August 1999 ti Commissioners present: Elliot Rosenberg, Chair Pro Tern,Ralph Shaw,John Johansen, Greg wirs n. The Chair called the meeting to order at 6:55 p.m.with a quorum present. 6:55 PUBLIC C 1 P. ITT: there was no public comment. Old Business: 1 Mir. Sherman noted that at the last meeting he was asked to write a letter to property owner Mr.Feigenbaum regarding removal ofa ramp attached to a 1 OA float at Jehu Pond. The letter has not been written yet because Mr. Sherman is attempting to track the past history of the property which had some contraindications of what is permitted. The ramp has not been removed as of this date. Little River Boat Yard is aware that Mr.Feigenbaum will be receiving a letter from the Conservation Commission on this issue. . ates atcce s restriction at Quashnet Bogs: Mr. Sherman met with the Deputy Police Chief and representatives from Jacobs on their plan for gates and access restrictions to the bogs. These locations were approved by the Selectmen(The Conservation Commission had given prior approval pending approval by the various Town departments). 7:00 SHEILA A.B.KRAEUTER for a Determination of Applicability on the proposed addition ofa denitrifying unit to an existing septic system to increase the number ofbedrooms to four at 92 Whippoorwill Circle,Assessors Map 125,Block 186. Mr. Sherman applauded the Kreuters for corning forward and seeking a permit,since many other homeowners do not under similar circumstances when adding bedrooms. He asked them to come in to the office prior to issuance to add language concerning the denitrifyiing system. Public comment: none. r VOTE; Motion made and seconded to fired negative. Unanimous vote. NEGATIVE DETERNUNATION *` 7;05 ALICE BORDEN for a Determination of Applicability on a proposal to replace patio blocks below a deck and to replace landscape timber stairs to the pond at 26 Fells Pond Circle,Assessors snap 122,Block 217. There is no net change to the property. Public comment: none. VOTE: Motion mach and seconded to find negative. Unanimousote. NEGATIVE DETERMINATION. Return to Old Business: 2 Coordination of permitting under Ch. 172 w.Board Of Appeals permits: We have an official notice from the Zoning Board of Appeals as to how we should meld our permitting process with theirs. when a Board of Appeals permit is necessary,under the Act a property owner only has to apply for a Board of Appeals permit. Under the By-law a property owner must actually obtain the permit. ti There is,therefore, a time period lag. Mr.Rosenberg has suggested that one solution is to have the property owner obtain a permit from the Board of Appeals before they can apply to the Conservation Conurnission. Diana noted that Mar. Gooni has stated to her that the Board of Appeals does not want to issue permits without prior approvals from.the Conservation Commission because they cannot take back .5 i
