Mr.Ferolito was present(his representative, Mr. Costa was not present). lir.Rosenberg informed that he is the Vice-Chairman on the South Cape Civic Association, and asked Mr.Ferolito if he was willing to have hire hear the matter or if he wished him to step aside(which would require the matter to be set aside to another night as there would not be a quorum). This is a land locked lot. The only issue,therefore,is lot coverage as there is a formula for allowing a certain amount of the lot to be left in its natural vegetative state. The septic plan looks fine. Mr. Rosenberg noted that the Board of Directors of the Association as noted might have to approve the structure. Mr. Ferolito noted, for the record,that he has no objection to have Mr.Rosenberg sit and vote on this permit. Mr.Johansen noted that Mr.Kaufman submitted the package using Mate forms,not those by the Town, and that they were haphazardly put together. Mr. Sherman will inform him of the correct procedures. Public comment: none. VOTE: Motion made and seconded to close pending a revised plan showing the naturally vegetated buffer and an updated N01. Unanimous vote. CLOSED PENDING. 7:15 CAROLE A.MO RE to amend the Order of Conditions for SE 43-1679 to pernuit removal of six pine trees and a request for vista pruning,with maintenance in perpetuity,at 76 Amy Brown Road, Assessors Map 115,Block 18. The Moores were present. The six trees in question represent a hazard because they could fall during a storm. Mr. Sherman noted that the Moores have maintained the property y keeping the Douse a sufficient distance from the wetlands with an appropriate vegetative buffer strip. Therefore,the removal of the pine trees should not be a problem. lir. Sherman recommended approval. Public comment: none. VOTE: Motion made and seconded to accept the amendment ofthe application. Unanimous vote. AMIENDMEENT ACCEPTED, 7:20 CSL DEVELOPMENT COMPANY, 110 Popponesset Island Road, continued from 1 July 1999. Plans have not been reviewed. A continuation was suggested. Atty. Carter stated the playas are the same except for the pathway. Mr.Rosenberg stated the plans are supposed to be available for the public to view at least five days before.the hearing. This is in violation. VOTE: Motion made and seconded to continue,at the request of the applicant,to 8:05 p.m. on 8/26199. Unanimous vote. FEARING CONTINUED.
