VOTE: Motion made and seconded to continue the hearing to 9 September • 1999 at the request of the applicant. Unanimous Vote. HEARING CONTINUED, 8:00 GERALD SEGEL for the installation of an 18 x 36 foot Gunnite pool with associated dry ell within an existing lawn area with mitigative plantings added to the Naturally vegetated R ffer at 132 shore Drive west. Mary Leblanc presenting. It was a very disturbed lot with an eroding bank. The pool would be in the 0-100' buffer. There is an ecology mix lawn there now. The lots are 7 ' wide and there is a problem with access. They have requested permission to access through an adjacent lot. Permission was granted and is in the file. one small oak tree has to be removed. Mr. Sherman stated the CommiLssion cannot give permission to work on the other lot, it would have to be through an RTA. Ms Leblanc asked if that would apply if they avoid removing the tree? Where is no need to remove any vegetation. Mr. Sherman stated they would be altering a lot not In this filing. Mr. Fitzsimmons asked if there is much erosion? Ms Leblanc stated no. She advised Ms Roretos had a concern with rosy rugosa and she revised the plant list to beach plum and bayberry. Mr. Rosenberg asked if the area is to remain lawn? Ms Leblanc stated they will put back the lawn removed for access. Mr. Rosenberg stated if disturbed for the pool, it ought to be replaced with vegetation rather than lawn. Ms Roretos stated there is a very well vegetated ' to the top of the bank. Ms Leblanc stated there is no concern for run-off. The lawn is ecology mix. Mr. Sherman advised Board of Health comments stated they must conform to pool setbacks.
