If they close one path and <br /> they- are told they cannot use another path, they will be back here. The <br /> Chair admonished that she was bringing up the property issue again. <br /> Mr. Butterworth stated Mr. Grotzke did use the reasoning there was <br /> alternative access and seems to be justifying closure based on alternate <br /> access not on the issue the Commission defined. <br /> Mrs. David Foley pointed out the vandalism did not begin until the path was <br /> closed. Again, it was pointed out that is not the Commission's issue. <br /> Mr. Grotzke stated the Agent called him to this site guise because of indirect <br /> access a lot of the cedars have been cut don and strewn to the other side o <br /> the path; it is clearly vandalism. <br /> The Chair stated it was agreed to continue this because of the BVW. <br /> Atty. fan Creed, on behalf of the Popponesset Beach Association., stated it is <br /> in the loo year velocity zone and the Cape Cod Commission's regional policy <br /> plan sloes not favor any construction in a velocity zone. He asked if Mr. <br /> Grote has addressed that? <br /> Ms Boretos stated she does not believe the pathway is in the v-zone, it is in <br /> n A-zone. Mr. Grotzke stated the V-zone is further to the ocean. Atty. <br /> Creeen stated Deans Pond is a wetland and asked will this be an impact on <br /> that? <br /> Ms Boretos stated this is a designated Coastal Zone Management Barrier <br /> Beach. Under the Barrier Beach regulation it includes dune and beach <br /> restoration, enhancement of dunes is an approvable project. <br /> Mr. Foley stated the application does not refer to the 100' buffer zone and <br /> Deans Fond. Mr. Sherman stated when it was sent back for a revised plan <br /> shoring a correct BVv, they should also incorporate a 100' offset. Mr. <br /> Grotke agreed. <br />
