9 September 1999
Page 8.
VOTE: Motion made and seconded to close subject to an on-site to determine
pruning restrictions. Unanimous Vote.
CLOSED .
8:05 CHARLES TUITE to add an additional drywell to the existing system
t 6 Crosstree way. John Slavinsly presenting. The septic was up-graded
year ago. They are selling the hone and it was determined it was a five
bedroom home. They have added a unit to the leaching for five bedrooms.
Mr. Sherman asked if it is a nitrogen system: The Commission will be
looping at former permits to determine the number of bedrooms and if there
are none shown, the Assessors records will. be reviewed.
Mr. Johansen advised taxes are owed.
Public comment: none.
VOTE: Motion made and seconded to continue the hearing to 7 October 1999
at 7:25 p.m. at the request of the applicant. Unanimous Note.
HEARING CONTINUED,
8:10 MAURICE J. FEIGENBAUM for a Determination of Applicability on
the attachment of a 55' aluminum ramp from a Harbormaster permitted 10A
float in Jehu Pond to a previously permitted stairway down a coastal bank at
32 Jehu Pond Road.
Mr. Sherman met with him and assisted him in filling out the RDA. This
project was the subject of some controversy. Town Counsel has given an
opinion on 10floats and it is a 10float, Harbormaster approved. He
suggested that Mr. Feigenbaum apply because the ramp is bolted at the
landward end to a set of stairs. He recommended negative. He did not feel
the Shellfish warden's opinion could be considered because of Town Counsel's
opinion.
Mr. Rosenberg did not disagree but would like to investigate this further with
Town Counsel.
Mr. Sherman stated there may be an appeal and this will be decided on
different level.
