J <br /> September 1999 <br /> Rage 9. <br /> Rick York, Shellfish warden, disagreed and stated the Commission should <br /> reject this. whether Town Counsel approves of the float and dock is one <br /> thing but attached to shore is another. Mr. Sherman stated the attachment <br /> to land is on the agenda. Mr. York stated the attachment is not benign. He <br /> asked, if it falls on someone, is the Commission liable? In terms of shellfish, <br /> the design is a problem. It will negatively impact shellfish. <br /> Mr. Rosenberg asked if he meant the ramp r the whole thing. Mr. York <br /> stated it will impact on shellfish productivity. He stated the Harbormaster's <br /> jurisdiction ends at high water. He asked if Town Counsel's opinion was for <br /> this case? Mr. Rosenberg read from Town Counsel's letter. <br /> Ms Boretos thought two different permits were being discussed. It can be <br /> left to the local Harbormaster but that does not speak to the local bylaw. Xt is <br /> something to look at as there are two different permitting systems. 10A docs <br /> not exempt anyone from Jurisdiction. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative. Unanimous vote. <br /> Mr. Rosenberg asked permission to contact 'flown Counsel on behalf of the <br /> Commission. <br /> NEGATIVE DETERMINATION. <br /> 8:15 LAUREN MARINO for a Determination of applicability on the <br /> installation of fencing, with clearing as necessary, at 24-26 Jeep Place. Ms <br /> Marino was present. There is a fence down the back lime and she wants to <br /> put a wood fence against it. <br /> Mr. Sherman asked that the fence be raised to allow for wildlife access. Ms <br /> Marino was amenable. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative.
