They needed a variance <br /> from. the Board of Health. Due to the shape of the BVW there is a small <br /> encroachment. The client would be grilling to install a denitrifying system for <br /> the house. Mr. Sherman stated the Commission would have to insist upon <br /> that and they could then go within the 5W in the one spot. He asked if there <br /> was any objection to both silt fence and ha bales` This was agreed. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to close pending submission of a revised <br /> plan showing silt fences and denitrifying system and the Board of <br /> Health approval ofthe new septic plan.. Unanimous Note. <br /> CLOSED PENDING. <br /> 8:25 RICHARD BARRY Y for a continued hearing to expand an existing four <br /> bedroom house to include house and deck additions at 44 Waterway. Michael <br /> hael <br /> Grotke provided abutter receipts. This was readvertised for an address <br /> correction.. It is an expansion of an existing dwelling. It is more than 67' <br /> across lawn to the top of the Coastal Bank. It is in the flood plain. There is <br /> no expansion of bedrooms. Board of Health required a septic inspection. <br /> Mr. Sherman advised the Commission has adopted a policy to see if the <br /> building permit states the number of bedrooms. Mr. xrotke stated the plan <br /> shoves three bedrooms. one room, while it is not a bedroom, could be <br /> interpreted as one. <br /> Mr. Green returned to the hearings. <br /> Mr. Shaver stated there are additions to existing rooms. <br /> Mr. Sherman stated the Commission cannot approve this until the Board of <br /> Health floes. There was discussion of the need for denitrification. <br /> Mr. Fitzsimmons' stated that does not have anything to do with ghat they are <br /> applying for. <br /> Public comment: none. <br /> VOTE: Motion rade and seconded to continue the hearing to 23 September <br /> 1999 at ;30 p.m. at the request of the applicant. Unanimous Note. <br />
