18 November 1399 <br /> Page 6. <br /> Atty. Glenn woods, representing the applicant, stated the issue the Agent <br /> wised is lack of continuity. As far as the Cowhig hearing, there are no issues <br /> left and they would be prepared to close the hearing. It is the applicant's call <br /> and jeopardy. <br /> Mr. Rosenberg stated if a Commissioner has net been dere, they cannot be <br /> signatory to the hearing. Atty. woods stated if a quorum is met, it does not <br /> have to be any four once a vote is taken. He asked when they would be <br /> assured of the four members, whoever they may be` <br /> Mr. tarot ke stated they are here because Mr. Sherman did not see the .four <br /> stakes on site; nothing has changed. <br /> The Chair asked what are the woodland issues at this point? Is the wetland <br /> line satisfied? He was told it is. Concerning Board of Health, variances <br /> sought have been approved. Mr. Sherman left the hearing to ask Board of <br /> Health Agent's opinion. <br /> Mr. wirsen stated, regarding the variance the 30 days has passed, it is <br /> conditional approval. The final issue for closure is the Board of Health. <br /> Mr. Sherman was of the opinion other dangling issues have been resolved. <br /> The Chair stated he wanted to be sure next time it will be over and done <br /> with. <br /> Public comment: <br /> Joan Quilty stated she has been here 6 or 7 times. <br /> Mr. Sherman stated if the septic problem can be sorted out, he would <br /> recommend approval. <br /> Dave Foley stated at a public hearing, you are obligated to take testimony <br /> from the public. It is not the public's fault this has been continued. He <br /> advised he is a PE and thence are reasons this should not be approved. He <br /> asked under what jurisdiction it ice being approved. He read from regulation <br /> 1 . Is this to provide access to the beach or the water? Is this maintenance <br /> of ars existing structure? It is a new building. Is this being undertaken to <br /> provide access to the beach and the water? <br />
