2 December 1999
Page 4.
across the wetland and you can walk out to the new home on the other side.
Although not upland all the way across, there is a little upland berm that bi-
sects the property.
Mr. Sherman asked, on page 2 of Mr. Schall's report, second paragraph,
second sentence, "the natu l buffer zone beyond the limit of work will also
prevent disturbance to the soil humus layer and layer of leaves that are in
the vernal pool habitat", if he is saying that the vernal pool habitat ends on
this lot at the work limit? Mr. Schall stated no, under the bylaw the vernal
pool habitat buffer zone runs at loo . Mr. Sherman stated according to
} information Mr. Schall provided, some things he just said. 30 meters and cited
references 75 meters to 194 meters, that is certainly more than 100' so the
hole lot would be vernal pool habitat, would it not?
Mr. Schall stated a significant portion of the lot falls within the buffer zone
to the vernal pool habitat. As he understands the bylaw, the vernal pool
habitat runs to the vegetated.......Mr. Sherman asked, 100' from the
vegetated wetland and within that 193', is that not an area which spotted
salamander could and would use for travel? 1r. Schall stated potentially,
hat he has indicated is that the primary corridors are going to follow the
topographic gradients. Mr. Sherman stated whether or not that is true sloes
not eliminate this area as potential vernal pool.habitat. He asked does it` In
other words, the area between the house and the work limit is forested and in
natural state, at the moment, and would be typical vernal pool habitat in
tens of the migratory patterns of salamanders. Mr. Schall stated not if
they show a fidelity towards the topographic. Mr. Sherman stated that has
not been authenticated. Mr. Schall stated it has not been authenticated on
this site. The referenced literature that he presented is work dome in
Massachusetts that did document a.strong fidelity towards north and south
migratory corridors and that is the reference work. Mr. Sherman asked if
this is in the southern part of the lot? Mr. Schall stated this is principally to
the easterly side.
Ms Boretos stated southeast of the pool. She stated the reduction in the
house size and the submission of Mr. Schall's report does not overcome the
significance of this area being vernal pool habitat. She would recommend
denial of the project because it does not meet the performance standards of
the 1lashpee wetlands Protection regulations, 172 Section 23, part IC,
which states that no project or activity shall have an adverse effect on the
vernal pool habitat by altering its topography, soil structure, plant
community composition, hydrologic regime and/or water duality in such a
way so as to result in a short-term, intermediate, or long-team adverse effect
