SYSTEMS WHERE THE SEPTIC SYSTEM WILL COMPLY WITH H TITL <br /> AND MASHFEE BOARD OF HEALTH REQUIREMENTS" <br /> Note: If the applicable D.E.P.. Storm Emergency Regulations do not in-clude any <br /> of the above categories, said categories of work shall not be eligible (even <br /> if listed above) for a STORM EMERGENCY CERTIFICATE under this <br /> regulation. <br /> (C) For all activities described above, the following shall apply: <br /> - <br /> No work shall be done without a STORM EMERGENCY xENCY CERTIFICATE <br /> being issued by the Commission or its Agent. Said Emergency Certificate shall <br /> be applied for on a form as issued by the Commission. Said form, when approved <br /> by the Commission or its agents, shall be considered to meet the procedural <br /> requirements for obtaining an Emergency Certificate. <br /> - Said STORM EMERGENCY CERTIFICATE, for the activities cited immediate) <br /> above must be requested no later than the similar(applicable) time period asspeci- <br /> fied by the applicable D.E.P. emergency regulations, except as ternminated sooner b <br /> a vote of the Commis ion. For said activities for which an STORM EMERGENCY <br /> CERTIFICATE was not sought in a timely manner, as specified above, and for all <br /> other categories or for work not falling into the categ ones above a Request for <br /> Determination.of-Applicability or Notice of Intent will he required, under normal <br /> procedures as prescribed under Chapter 172 and its regulations. <br /> All work performed under a STORM EMERGENCY CERTIFICATE must b <br /> completedithin the time periods as specified by the applicable D.E.P. emergency <br /> regulations, except as terminated sooner by a vote of the Commission. <br /> For any permits under this section, the Commission reserves the nght to require any <br /> additional information, to impose conditions, or to deny all or portions of any <br /> proposed work, as deemed necessary to protect the wetland values as expressed <br /> in Chap. 172, section 1, Such conditions may be unposed when the permit is issued, <br /> or should actual or.potential damage to the resource areas (cited in section 2 of <br /> Chapter 1 2) become apparent, at any time during the progress of work on the <br /> property involved. <br /> - For all activities done under STORM EMERGENCY CERTIFICATE, theCom- <br /> mission must be notified in meting of its completion within 10 days of said comple. <br /> tion. The Commission retains the right to inspect such work for one year following <br /> said completion, and may require the restoration (under procedures deemed ne- <br /> cessary) of any resource area as described in Chapter 1 2 and its regulations) that <br /> has been altered. Any activities done beyond the scope of those as described in <br /> in the application for the STORM EMERGENCY CERTIFICATE shall be due <br /> cause for enforcement as described in section of Chap. 172. <br />
