MOTION:. George Green made a motion to Deny Without <br /> Prejudice, request the Applicant provide proof of legal ownership <br /> of the property, and resubmit Application under his name; which <br /> Motion was seconded by Ralph Shaw and so voted unanimously. <br /> 8 ;20 Gary Vitale-Proposed float relocation and bulkhead <br /> restoration at 43 sanuit Dane, Assessor' s lap 30, <br /> Block 5. Notice of Intent. <br /> The Chairman recognized David Sanic i, Cape and Islands <br /> Engineering, who reported certain revisions need to be made, <br /> and that some of the neighbors are unhappy with the proposal. He <br /> thea rFequested this matter be continued. <br /> Mr. Sherman reported that having rade an inspection of the <br /> site he realized the BVW is not shown on the plan. He reported <br /> the area has been mowed for years and perhaps was no' <br /> recognized <br /> for what it is. a found cranberry vines and sphagnum moss to be <br /> growing there. There is water seven inches from the surface of <br /> the ground. He suggested a wetland be determined by a Botanist. <br /> Nor. Sherman also suggested this property undergo an inland <br /> bank-wildlife habitat review and intends to encourage the <br /> engineer to spear with the owner regarding concentration of <br /> erosion control, He stated that if the plants are allowed to <br /> grow up into a true BVW with shrubs, there is a possibility that <br /> the root system would provide protection for the area. <br /> The Chairman suggested Applicant consider a second filing if <br /> it is determined there are erosion concerns. <br /> Diane Boretos reported several people have consented on the <br /> float, stating there had not previously been a float at this <br /> location. The notice states . . .relocation of an existing <br /> floats . <br /> Mr. Sherman inquired if any Chapter 91 licensing e ists; to <br /> which. Mr. sanic i replied, "No" . <br /> Mr. Sherman suggested Applicant consider ready ertisi g a <br /> proposal for a new Moat, especially in light of the opposition <br /> expressed. Making ing reference to the plan Mr. Sherman noted an <br /> eroded area designated to be filled with clean sand, stating this <br /> would not be possible as it is now land under a water body. <br /> The Commissioners suggested using fiber rolls along the <br /> edges . <br /> There being no public comment or further Commission <br /> discussion, the Chairman entertained a motion. <br /> MOTION-_ Ralph Shaw made a motion to continue this matter <br /> to April 27, 2o00, at p.m. at the request of the Applicant <br /> -16- <br />
