is being opposed by a neighbor concerned with view obstruction. <br /> Legal negotiations have been underway, and it has been agreed <br /> upon (lay 26th) litigation will not be necessary if the Applicant <br /> adjusts the location of said dock. <br /> Mr. Grotske requested Commission input as to the relocation, <br /> and more specifically to the proximity of the upland area. <br /> Mr. Sherman stated the Commission would be unable to close <br /> at this Hearing. <br /> Greg wirsen requested Mr. Grotske to review prior issues of <br /> concern regarding location. <br /> Mr. Grotske, making references to the plan, stated the only <br /> issue had been the distance in regard to wildlife habitat. He <br /> stated the dock is proposed to be placed approximately two feet <br /> above the marsh, fiberglass mesh grate is to be used, there will <br /> be very little .impact on the growth of the grass and will have no <br /> visual impact . However, a raised section of five ft. ) feet <br /> will be necessary between the mean low water and the flet to <br /> allow for public access . <br /> Diane Boretos stated she has reviewed the site and considers <br /> the property to be a very valuable wildlife habitat peninsula, <br /> which is the reason. for commission concern regarding the location <br /> of the dock being placed as far away from the peninsula a <br /> possible. <br /> Ms. Boretos requested Applicant not use electrical lights <br /> aloe the walkway, stating this would cause a disturbance to <br /> nesting birds. Nor. Grotske agreed to the limitation of lighting <br /> to the dock area only. (There was some discussion as to <br /> alternative low-impact lighting along the pathway. ) <br /> There being no public co rent or further Commission <br /> discussion, the chairman entertained a motion. <br /> MOTION: Ralph Shaw Stade a Motion to continue this matter to <br /> May 25th at 7: 10 p.m. , at Applicant ' s request; which Motion was <br /> seconded by Greg wirsen and so voted unanimously. <br /> : 00 Edward Cohen-To amend the order of Conditions for S <br /> -1709 to modify the existing footprint and to repair existing <br /> stairs to a dock at 70 Fells Pond Road, Assessors Map 122, Block <br /> 179 . <br /> The Chairman recognized Edward Cohen, who requested an <br /> amendment to the existing order of Conditions for an additional <br /> room to the rear corner of the house; and to repair the stairway <br /> leading down to the dock as a number of railroad ties have <br /> deteriorated. <br /> -12- <br />
