22 June 2000 <br /> Page 3. <br /> Mr. Heimberg submitted signatures of those abutters in favor of the request. <br /> All of the abutters approve. They are asking to acid sand from time to time <br /> and to regrade the sandy beach that has been done. Theywill put in <br /> blueberries and winterberry at each end to replace something taken out. He <br /> described the project and showed photos. <br /> Mr. Sherman stated there is only one area that is problematical. Permission <br /> wasgiven to clear land before the regulation for lV s. when amended <br /> order was filed, current performance standards apply. It is not <br /> grandfathered. He advised he is in the process-of writiLng a regulation to give <br /> some flexibility to look at mitigating measures. He hopes to have this ready <br /> next meeting. The Commission could not grant the request for mowing until <br /> such time. He suggested the Commissioners get out to see the area. He will <br /> get together with Mr. l eimberg for compensatory plantings that would be <br /> allowed. He read from the regulations. The other six issues are not a <br /> problem in perpetuity. The Commission can hold a public hearing and when <br /> the regulation is in place, act of this amended order. The main concern about <br /> moving would be destroying-habitat for wildlife. <br /> Mr. Heimberg was willing to hold the hearing open and sit down to work <br /> something out. <br /> PUBLIC COMMENT: Peter Dini io asked if there was no application for <br /> amendment, would they still be able to use the Gravely It was extended and <br /> they could use the Gravely this year. <br /> VOTE: Motion made and seconded to continue the hearing to 20 July 2000 <br /> At 7:15 p.m. at the request of the applicant. Unanimous Vote. <br /> HEARING CONTINUED, <br /> 7:25 11 ARCEL J, MURAD to amend the order of Conditions for SE 43- <br /> 1875to include a cabana addition at 19 Keel way. Mr. 1 lurad was present. <br /> He advised he had the approval of Z A and ARC. Inadvertently, he thought <br /> it was approved by Conservation. <br /> Mr. Sherman stated this is on the street side and had no problem with the <br /> amended order. Mr. Murad advised outstanding taxes will be paid tomorrow. <br /> Public comment: none. <br />
