17 August 2000 <br /> Page 5. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative. Unanimous vote. <br /> NEGATIVE DETERMINATION. <br /> 7:40 EDGAR R, QUIET for a Determination of Applicability on proposed <br /> replacement of a portion of an existing deck with a room addition 16' x 22' at <br /> 196 Rock Landing Road. Mr. & Mrs. Quiet were present. <br /> Ms Boretos. stated it is approximately 13' to the wetland. Past cutting of the <br /> wetland has occurred. The area has been clear-cut ' in, Two different <br /> drawings were submitted to Building Dept. and Conservation. She <br /> mentioned to 11r. Quiet about the 3 ' buffer to the wetland and he cannot <br /> meet that buffer. There are plans with three different dimensions. with <br /> the existing violation, the Commission should consider an Enforcement order <br /> and restoration. <br /> 4 <br /> Mr. Quiet stated the permit for the trees included brush in that area. Ms <br /> oretos stated it only dealt with three trees. <br /> The Chair suggested Mr. Quiet ask for a continuance in order to consult with <br /> staff to work this out. He told Mr. Quiet to have a clear plan in the office five <br /> days prior to the continued date and to be sure that there is only one plan. <br /> Mr. Quiet is to consult with the Agent with respect to whether or not there is <br /> a violation and, if so, how to take cage of it. The Commission is not <br /> enthusiastic about any move towards the wetland. <br /> Mr. Quiet stated the addition was going to be built on sono tubes to minimize <br /> impacts. <br /> Mr. Rosenberg stated regulations stated there must be an untouched area of <br /> 50' to the wetland, with the minimum acceptable of ', Mr. Quiet might <br /> want to discuss that with the Agent before corning in again. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to continue the hearing to 7 September <br /> l 2000 at 7:10 p.m. at the request of the applicant. Unanimous Vote. <br /> HEARING CONTINUED, <br />
