1 September 2000 <br /> Page 8. <br /> 7:35 DAVID COHEN, 18 Wheelhouse Lane, continued from 30 March 2000. Michael <br /> Grotzke gave the background of the project. Board of Appeals approved this pending <br /> the Commission's finding. He believes all issues are resolved. <br /> Ms Boretos stated Mr. Sherman asked her to raise the issue of hoer Mr. Grotzke arrived at <br /> Mean High Water. According to Chapter 91, it should be based on a 19 year cycle. He <br /> wanted to point out that Chapter 91 would not approve pilings. Mr. Grotzke stated the <br /> Mean Tidal Cycle is 2.7`, which is the range in Waquoit Bay. He took a very high seasonal <br /> average to be conservative. Because of the salt marsh, it is a very high rack line, more <br /> landward than high would be. <br /> Ms Boretos stated this site is in the ACEC which is shown on the plan. Mr. Sherman spoke <br /> with the new, Circuit Rider and asked hover the Department would review "no adverse <br /> effects in the ACEC" and that is ghat they tale him, below Mean High later. She <br /> stated these are the only issues that Nor. Sherman has raised, she thought the Commission <br /> could approve this pending verification of the Mean High Water line. If the NOAH <br /> records are in the file and show this elevation, 2.7, to be landward of that, the whole <br /> structure......Mr. Grotzke interjected that 2.7 is the tidal range. Ms. Boretos stated all of <br /> the pilings are outside or landward of the Mean High later and it is shorn on plans. Mr. <br /> Grotzke stated yes, exactly. <br /> Public comment: none. <br /> VOTE: Motion crude and seconded to close pending verification of the Mean High <br /> Water line on the plans and revised plans to reflect the correct address. <br /> Unanimous s Mote. <br /> CLOSED PENDING. <br /> i <br /> 7:40 GAY VITA LE, 43 Santuit Lane, continued from 20 July 2000. John Slavinsky was <br /> present. He spoke with Mr. Sherman today and he was okay with the dock. Originally <br /> they came in and granted to rebuild the bulkhead; that was out of the question. lir. <br /> j Sherman was adamant that he wanted the wetland line shown on the plan. <br /> Public comment: none. <br /> VOTE: Motion crude and seconded to close and issue pending Board of Appeals and no <br /> more mowing of the illegal lawn. There will be no sign off on the building permit <br /> until violations, including the illegal lawn, are rectified. This is technically a coastal bank. <br /> Ms Boretos stated all wetland resources are not shown.
