19 October 2000
Page 5.
7:25 CHARLES J. VI LAS to authorize portions of an existing licensed }pier, ramp, float and
pilings not conforming to the license including a 3' extension to the timber pier, the re-
configuration of the floats and the installation of timber pilings in Shoestring Bay at 71
Frog Pond close.
Mr. Sherman stated it is more than a 3' extension. The total length, including the float, is
o' longer. The Harbormaster does not have a problem with it, nor does the Shellfish
Warden. chapter 91 will not give their approval without our approval._
Mr. Rosenberg asked if it should be re-advertised? Mr. Sherman stated someone could
challenge this. He suggested a continuance to re-advertise with the correct length in
the ad.
Steven Silva of Holmes & McGrath advised the 3' refers-to the fast 3" of the pier. That is
ghat needs to be licensed.
Mr. Sherman stated, from the original plan, there were floats added. The pier was longer
by more than " The Commission could order there to re-configure those floats as they
were done illegally. There is no compelling reason to approve the three floats. It was
noted the dashed line is the licensed location. He suggested a two week continuance
and he will talk to the Shellfish warden to see if changes are needed. Mr. Silva stated
there is a letter from the Shellfish warden that he has no problem with it. Mr.:Sherman
stated the Shellfish warden is supposed to make comments on "Land under the Ocean",
as well as "Shellfish".
Public comment: Steve Rowan advised he ran into the Shellfish Warden and he stated it
is better this war.
r
Brad Caffyn stated he was there when that statement was made.
Mr. Sherman stated the Commission could approve a dock of this length, but not all t
hose components. They could make it with more walkway and less floats.
The Shellfish warden arrived. Mr. Sherman asked if re-configuration was a problem? Mr.
York stated it is not a problem for shellfish, there are none. 1t is not a big resource area.
Up in the marsh them are mussels. This cloak gold not have an adverse effect. The
. Chair asked if he-was aware of'the fact that thea are floats rather than a walkway to go
out to the main float? No, he never got a copy of the plan. It was agreed this should
be continued as Mr. York is not prepared to discuss this.
The Chair stated this hearing must be continued.'
VOTE: Motion made and seconded to continue the hearing to 2 November 2000 at
7:35 p.m. at the request of the applicant. Unanimous Vote.
HEARING CONTINUED.
