r <br /> 19 October 2000 <br /> Page 4. <br /> Mr. Johansen requested abutter notification receipts and the attestation-of ownership. . <br /> Mr. Hayes will provide the attestation and gave the receipts to Mr. Johansen. <br /> The Chair stated the language ought to be revised after bringing in other sand to reach <br /> the projected elevation that it is not a storage area anymore. Mr. Hayes agreed <br /> The Chair asked if there are plantings proposed along the steep area. Mr. Hayes stated <br /> no plantings are planned, the area is stable. The Chair asked if the sand was being <br /> moved from where it is being stored to the beach directly? <br /> Mr. Rosenberg asked if this is a permanent situation Mr. Hayes stated initially the scads <br /> from the treatment plant will be used on the golf course. Then the area will be leveled to <br /> the 1942 elevation. <br /> Mr. Rosenberg stated the Commission should have something as to what the future use <br /> will be, a statement for the permanent status. <br /> Mr. Sherman stated nothing would preclude them from coming in with an applic ation <br /> for anything. We should make sure it is not used for access any more. <br /> Mr. Rosenberg asked what the purpose was of building it back up to 19422 It you have <br /> lard there which is 10' above the high grater mark and you are going to build it back up <br /> to the 1942 level, you are creating a parcel of land which makes it useable and has n <br /> restriction on it's use. <br /> Mr. Sherman stated future use would depend on the performance standards at that <br /> time. Ms Boretos stated it is useable noir . <br /> Public comment. none. <br /> VOTE: Motion made and seconded to continue the hearing to 2 November 2000 at <br /> :30 p.m. at the request of the applicant. Unanimous Vote. <br /> HEARING CONTINUED. <br /> 7:20 PRISTINE KIRSCH for a Determination of Applicability on the limbing of branches and <br /> replacement.of cut trees/bushes with indigenous plants at 15 Tulip Shell Way. <br /> Nis Boretos advised lir bing and removal of other vegetation was done by another <br /> person, not the owner. After many months, they finally filed. She recommended <br /> negative 3. After the fact fees must be paid. <br /> Public comment: none. <br /> VOTE: Motion made and seconded to find negative upon receipt of the appropriate <br /> Fees. Unanimous Vote. <br /> NEGATIVE PENDING. <br />
